Gale Agrees To Drop $500,000 Lawsuit Against City, Report Says

POSTED: 3:56 pm MDT August 16, 2005
UPDATED: 5:44 pm MDT August 16, 2005

AURORA, Colo. -- A 29-year-old Aurora father who was shocked with a stun gun during a dispute over a Chuck E Cheese salad bar reached a plea bargain Tuesday and pleaded no contest to disturbing the peace, according to the Rocky Mountain News.

The city dropped five other charges file against Danon Gale as part of the plea bargain, the newspaper said He was also fined $500, the newspaper reported in its online edition Tuesday.

However, a municipal court clerk contacted by 7News Tuesday afternoon said that Gale was convicted of charges of refusal to leave when ordered and abusive language. He was ordered to pay a $524 fine, the clerk said.

The News reported that as part of his plea bargain, Gale agreed not to pursue a $500,000 lawsuit against the city of Aurora stemming from the Feb. 27 incident in which police said he became belligerent after he couldn't prove he paid for the salad. <snip>

2. Interesting that this article fails to mention whether he paid
for his meal or not, as that was what triggered the whole event. Perhaps we can guess that he did, since the pressure was on him to agree to refuse to sue the restaurant chain. We can only surmise as to any reasons the city would care so much about protecting a "private" interest.

3. Interesting read; sounds to me like he didn't
... You'll note he paid several hundred dollars in fines, and accepted a conviction. Probably deferred sentence, but that's just a guess.

Sounds like he got a hell of a deal. Riddle me this: if he had a half-mil waiting for him on a case that had any merit, why would he accept a conviction and fines?

4. That is one reason why I am anti-taser (too easily used)
That said, I always ask for a receipt. Also, I will NEVER EVER go to a Chuck E Cheese either, for many reasons. I hope they go bankrupt.

Cops always have their 'toys' available for such petty things but did nothing about the rapes down in New Orleans. Welcome to Bushland.
