Bev Harris BBV.org in defiance of tax law filing disclosure?
Beginning of April, 2006, I requested a copy of Bev Harris's blackboxvoting.org's tax exempt non-profit IRS form 990, as their fiscal year had closed in June of 2005.

Nonprofit 501c(3) organizations are required by law to provide copies of their 990 tax filings to any person making a request.

My April, 2006 email making the request......

I request a copy of BlackBoxVoting.org's IRS 990 forms, as a 501c(3) non profit organization.

If the information is posted online, perhaps you would point me to it, as I am unable to find it.

Bev's email response to me, acknowledging my request: (BBV.org's form 990 filing was due on November 15, 2005, but filed the maximum two extensions. She has claimed elsewhere that the first one was 'automatic', but no... a request for extension must be FILED, it is not automatic. She claimed the second extension was filed by the accountant and it was a 'surprise' to her. Also, "conventional wisdom" has nothing whatever to do with compliance with law).....

The due date for our first 990 is May 15, 2006. As regards posting it online, we
will follow whatever the conventional wisdom is for all the other organizations
like ours. I generally don't see their 990s posted online, but have no
objection to doing so if that is done by VoteTrustUSA, VerifiedVoting, and the
other election reform nonprofits.

Some snips explaining the legal requirements of 501c organizations in responding to 990 requests:

In response to a request for your annual information return you must provide a copy of:
· Form 990
· Any attachments, and
· All schedules

Response due dates - If a request is made in writing (i.e., by mail, fax, email, or courier), you must respond within 30 days of receiving the request.

An Exception to Providing Copies - An organization need not comply with a request for a copy of a document that the organization has posted on a World Wide Web page that clearly informs readers of the document’s availability and provides instructions for downloading and printing it, without a fee, in a format that exactly reproduces the image of the document as it was originally filed with the IRS. Upon receiving a copy request, the organization must notify the requestor within 7 days of the World Wide Web page address.

Although many organizations’ 990s are posted on guidestar.org, this does not satisfy the “widely available” exception for the public disclosure regulations.

Penalties for failing to comply with a request for disclosure - Once a request is made, failure to provide a copy of the requested documents by the response deadline (within 30-days of receipt of a written request) means that the IRS can assess a $20 per day penalty for every day that you fail to fully respond. There is a maximum penalty of $10,000 for failing to provide a copy of the annual information return (Form 990, schedules and attachments).

In addition, a $5,000 penalty for "willful failure" can also be applied.



BBV.org's fiscal year closed over a year ago. She claimed to have an accountant 'specializing in non-profits' working on statements and filings as of early in March of last year.

Thus far, the public has seen zero accountability for the funds donated to the organization. She claims to be in favor of transparency, but she does not practice it, though required by U.S. law.

She did permit the characterization on her site of DUers' donations during heavy fund raising after 2004 election as "chump-change". But we have no clue how much "chump-change" BBV.org collected in fiscal year 2004 & 2005, through Randi Rhodes' listeners, DU and others.

30 days have passed since the final extended filing date.

There are three ways for her to have complied with the law regarding a public request:

1) Post it on her website. She has not done so.
2) Email it. She has not done so.
3) Snail mail it, postmarked no later than today. I have no indication that this has been done (no email saying "It has been mailed"). The filing was supposedly done a month ago, you might think that to copy & mail it would have been done by now.

BBV.org is at risk of daily fines up to $10,000 and a $5,000 penalty for 'willful failure'. Is that responsible handling of donated funds?

I particularly wonder how those here who were donors feel about this?

Maybe it will show up in my mailbox, postmarked today, in a day or two. Do ya think? I don't. Why would an organization, devoted to 'transparency' and given two and a half months notice, wait 30 days to comply with public financial disclosure?

It can take months to get it from IRS, and that is BESIDE the point. BBV.org is REQUIRED BY LAW to provide it to any person within 30 days.

12. No, Guidestar takes a couple of months.
Guidestar is NOT accepted as legal compliance to a request anyway, at any time.

Any thoughts about why BBV.org would not want to comply with such a request?

It looks like she is working on a section of her website that will provide this info. As for her intent on ignoring your lawful requests, I don't have any judgment.

Why not do both? Why not send a strongly worded legal letter to BBV and a simple request to the IRS? It would be less stress.

Forgive me for not remembering past history and politics here but I don't see anything worthy of a raised blood pressure. If she is hiding the 990 filing, at least you don't have to rely on her to get it.

I like the format. Clean, easy to navigate, and I'm inclined to implement that format here. Because come to think about it, people shouldn't have to go to Guidestar to find out what's going on. I never knew about that site. We already have our IRS authorization form online, we might as well put our 990 online here at this site as well.

The other voting sites don't seem to be doing this, but I see no reason not to move the bar a bit higher for all concerned.

She chose to fundraise, and post on sites that allowed usernames, she can't now have it both ways.

61. Oh, yes. I made a post on DU in April
that riled her into outing my personal info on her site (though she scrubbed some of the more specific parts later) because I actually ASKED about FOIA results for which she had raised funds. I rekon by reading that thread, you know what my question was, since I asked it half a dozen times. Still no answer.

As for her diatribes about 'fake names', she accuses various different individuals of being all one-in-the-same (how does she invent this stuff? Not only is she paranoid, but one of her most precious 'researchers' is a paranoid, too). If you have followed along here on DU, you know that she has so many sock puppets, it's really pretty entertaining! 'Bailey77' was one of the most fun. Bailey knew everything that Bev knew... almost like being inside her head! Used all of her favorite phraseology, too.

The whole thing is very creepy, isn't it?

Why would an organization that is perpetually soliciting donations be reluctant to provide their 990 to the public, MORE THAN A YEAR after the fiscal year end? One would think that the organization would want to make it available as soon as possible, in order to show transparency of their finances. To show financial responsibility and that nothing is amiss or hidden. Wouldn'tcha think???

considering Bev flogs her "501c(3)" harder than any organization I ever see anywhere. And yet she seems to be dragging her feet (at minimum) in complying with the very laws that have given her that classification. Makes ya wonder, huh?

41. Well, that brings up a concern I have been developing lately...
Bev claims to have filed the 990 with the IRS on 5/15. That's all we have to go on... a Bev claim. Many of us are quite familiar with 'Bev claims'.

If she'd filed, what would be so hard about mailing a photocopy or emailing a copy within a period of 30 days?

Worrysome?

No, Bev, nothing for me to correct on DU. You dragged feet to be forthcoming with documentation (in fact a day late). I did not rely on my imagination as a reliable source, I used a calendar calculator.

Notation on the calendar calculation is that noon of first date to noon of last date is used. I used end of business day (filing 5/15) to end of business day(6/14). You are late. But who's quibbling your delinquency? At least these posts seem to have gotten you to FINALLY mail the required information!

You COULD have posted it on your site for ALL to see, but evevidently you opted against that. WHY?

Wonder if it would have been forthcoming had I not posted this thread? My opinion is that it would not, but hey, how could I know? Just an opinion based on history.

69. Yeah, finally. It's delinquent, but "in the mail", supposedly.
Bev talks on her site about how thrillingly, conveniently transparent BBV will be:

"asking for it by email will suffice to receive one by pdf."

It sounds so incredibly simple... but I asked for it two and a half months ago. 990 was supposedly filed a month ago, a pdf was never sent, though the claim is that a paper copy is now being mailed, though it's past the legal deadline.


"The 990 thread lets interested parties know that they can email us to get a pdf file of the 990 (beginning May 15) and also that we have made the decision to become more transparent than any other election reform site that we know of."

Uhhh.. Show me.


"We will post our 990s here on our Web site, to save people the trouble of requesting them."

Really? Where? Show me.

Why HASN'T the 990 been posted????? Many people have posed questions regarding BBV.org finances. WHY hasn't the 990 been posted?????

As I'm sure you are aware, I posted your email in its entirety on DU.

No adjustments of my posts are needed, as mailing of 990 copy is delinquent. End May 15 to end June 14 is 30 calendar days.

I do hope the 990 will be posted on BBV.org's website immediately, so that other interested members of the public can access these documents in a convenient way, rather than waiting 30+ days.

Nothing other than that is needed, as she has read everything posted here. She reads DU religiously (well, the parts about Bev, anyway), and refernces DU in her email to me.

How soon do ya think the 990 will be on line????

Pretty soon, I think, because she wants to be cutting-edge of transparency. :sarcasm:

about the need to consider efficiency of copying a 990 form. If there were a couple of requests, it just wouldn't seem to be an issue to accomplish it in 30 days. But were there a great many requests from people all over the country so that the project had to actually be "calendared" so that paper could be photocopied and mailed and needing to be an "efficient" undertaking?

Personally, I take it all as complete bullshit.

Ya know:

I had never before heard the word "calendared" WTF? I had to look it up to be sure it was real.

Seems that potocopying for the heaping piles of 990 requests had to be specifically scheduled, a whole month after filing. Amazing!

Course, I have been asking for a list of FOIA compliance/noncompliance for a year and a quarter without an answer, so I oughtta be used to it.

It will no doubt mean....oops, got busy saving America, must re-calendar it for the near future.

I'd be interested to know how many complaints were filed for non discloser last year and what if any fines we're levied.

The answers to those questions might shed some light on the likelihood of you being blown off.

83. Yup, "calendared" doesn't mean mailed. Doesn't mean shit, really.
If one were to "calendar" something, you'd think it would be for a date that was in compliance with law, rather than delinquent.

There can't be complaints filed last year related to 990 non-disclosure, as fiscal June 2004-July 2005 is their first year as a 501c (filing due 11/15/05). With two extensions, filing was due to IRS 5/15/06, and compliance to public request 6/14/06.

I would be interested in BBV's finances prior to 501c non-profit status granted 6/2004. Hmmmm.

If Bev has been told by her accountant that only three fines have ever been levied for non-disclosure and no fine was greater than 500 bucks then maybe blowing you off is worth it.

I'll look for info but I'm not as good as you I'm sure.

Blowing me off for $500 in fines might be "worth it" to her. But that $500 would be money donated by people who thought she would handle it for purposes more important than paying penalty fees to the IRS for non-compliance with the law.

I am not sure it would be "worth it" for her potential future donors to know that her organization has IRS issues.

I have not donated enough to your fabulous White Rose site, but I'm not rich and trying to do what I can in a lot of different places. This is my first post on DU and am astonished to see that you have huge issues with Beverly Harris. Hasn't she done good things for voting reform. I live in Utah, and have seen the media forced to address it, finally, because of Bruce Funk. This issue has absolutely obsessed me for years now and has turned me into a madman!
