King County prosecutors didn't think they could prove sexual assault charges against Sounders' star Fredy Montero because of a lack of "corroborative evidence" and the accuser's own account.
The woman said she tried to maintain a social relationship with Montero in the week after one of the incidents she complained about and before a second, according to a memo the King County Prosecutor's Office released Wednesday.
"The state has insufficient evidence to establish beyond a reasonable doubt that the suspect forcibly raped (the woman) or that she clearly expressed her lack of consent to sexual intercourse," Deputy Prosecutor Lisa Johnson wrote in her memo explaining the charging decision to Bellevue police.
"While the word of one person against an another may be sufficient evidence by itself to justify the filing of a charge, in this case (the woman's) account is severely compromised by her own descriptions of the events, her actions toward the suspect during the week intervening the sexual contacts, and the lack of corroborative evidence that should exist given (the woman's) account of events."
