Prop 8 judge to receive stay arguments today

On Friday both sides in the Proposition 8 case will present their arguments to Judge Vaughn Walker on whether he should extend the stay that is keeping Proposition 8 in place.

Walker ruled on Wednesday that the California ballot measure is unconstitutional but placed a stay on the matter postponing the reversal of the proposition until at least Friday. The stay was instated in connection with the appeal that the attorneys arguing in favor of Prop 8 filed.

This means that while the voter-approved proposition banning same-sex marriage was deemed unconstitutional, it remains in effect until the stay is lifted. Gay couples still cannot wed in California.

Today Walker will be presented with written arguments from both sides of the case.

'Gov. Arnold Schwarzenegger called today for the immediate restoration of same-sex marriage in California, urging the federal judge who overturned Proposition 8 to impose his ruling while the case moves through the higher courts.

Allowing gay and lesbian couples to marry "is consistent with California's long history of treating all people and their relationships with equal dignity and respect," said a legal brief written on behalf of Schwarzenegger.'
