Department Of Justice Appeals [MA] DOMA Ruling
With the good news that Judge Virginia Phillips ruled Don't Ask, Don't Tell unconstitutional comes the bad news that the Obama Administration has filed appeals against another judge's decisions to overturn the Defense of Marriage Act.

U.S. District Court Judge Joseph Tauro of Boston ruled in Gill v. Office of Personnel Management and Commonwealth of Massachusetts vs. Department of Health and Human Services earlier this year that DOMA violates the Fifth Amendment and impedes the state of Massachusetts's ability to define marriage.

While the Justice Department's appeal comes as no surprise, it will do nothing to endear the President to liberals and progressives offended by broken campaign promises.

3. This is a GOOD THING.
It takes the issue to a higher court, resulting in better precedent and it extends the benefits of the ruling to more than just Massachusetts.

8. No, it's not. Not for the people who brought this case to trial and won it. They should not be...
sacrificed for some higher principle.

13. Higher principle is why they brought the damn suit in the first place.

It's the biggest motivation to fight this battle. Massachusetts already has marriage; winning federal marriage benefits for people in one state are warmed up leftovers compared to the purpose of hitting DOMA as a whole.

4. Fierce Advocate ...
for the anti-gay status quo?

He believes DOMA to be discriminatory but not unconstitutional?

6. And the Obama administration continues to resist change and turn off its LGBT supporters
He and his White House team are no different from the Republicans on this issue.

11. Yeah, whatever happened to "change you can believe in"
Change isn't change if it reinforces the status quo.

10. Seems they timed the filing of this on the day of the judge's order to end DADT enforcement
Edited on Tue Oct-12-10 09:35 PM by ShadowLiberal
Lucky coincidence for the administration in the news cycle, or timed to happen when less people would hear it/people wouldn't take it as bad because of a judge ordering the military to stop enforcing DADT? I mean look at the front page, it's all about the DADT ruling, and I see on my google news list a story about the DADT order, but nothing about the DOMA appeal.

Edit: Oh, maybe it was just a lucky coincidence, I just read today was the last day they could file the appeal, that explains it, makes sense why they'd put it off as long as they could.

12. a lucky coincidence?
I would bet they timed it so that it would come out at a time when it would get lost in the hype of the DADT repeal. Something else which they are fighting.
