Police lab found 71 ng/ml of ambian cr in my husbands blood.
He had a script, and they want to charge him with owi. He was stopped on the side of our house coming home from work at 1:10 am. This happened several days after our mailbox was knocked over, a flower pot near our front door overturned,and a flag thrown in our yard. The destruction of property was reported by our daughter to the police. When I came home and parked the car in garage the paper sign that says Cindy stands w/ Osama and the duct tape that was used to adhere to our sign-bring them home-was missing. Three months before my husbands arrest from police, my family witnessed a man kick our cindy sign down, and run-this man left a ducked tapped sign saying Cindy stands with Osama. A year before my husband was arrested. Police tried to ticket my husband for his cindy sign. My husband asked why he was going to ticket him, and the police told him that he was breaking the law. My husband asked which one, and the police told him to look it up on internet. My husband explained his scripts to police, and indicated his medical condition. Muscle weakness. Can't balance, and didn't stand on one leg for police at 1:10 in the am. Also heel to toe he place his feet together to balance himself. I let the chief of police know the following day of my concerns. My husband was booked for over 3.5 hours in a small town where nothing happens. He was prevented from calling me. Chief said that is because everyone they arrest is to embarrassed to call family. I let him know he was denied a phone call and he then said it was to protect my sleep. I called to report my husband was missing,but his car was in our drive way,police dove his car around the corner from where he was stopped, and put it in our driveway. Operator of police station asked me to hold and a sargent got on the phone,and said he arrested my husband. I said for what. He told me he could not tell me. I told him I was coming to get him. It appears to me from my understanding of talking to doc, and pharmacist is that the rang police lab quote as being therapeutic is vast. The state 50-250. My husband is a R.N. and knows that therapeutic levels are not all the same.

1. Aw, just get a note from his doctor
about his condition. They'll have to drop the whole thing in the absence of either a breathalyzer test or a serum alcohol assay.

4. that is not true at all
for instance a friend naively believed this and refused a breathalyzer test, which meant he immediately lost his license

in addition he was convicted and went to jail anyway because the arresting officer simply testified as to his behavior and explained why he believed the man to be impaired

unfortunately someone under the influence of ambien is impaired and should not drive, the doctor and the pharmacist and anyone else associated with this script should have made it clear to the man that you NEVER take ambien unless you are IMMEDIATELY going to bed and to sleep

it doesn't matter that your husband had a prescription, alcohol is a legal product too but you are still not allowed to operate under the influence of it

ambien is a very, very serious drug and no one should be operating a motor vehicle with this drug in their system in my humble opinion

you will need an attorney to fight this, like it or not, R.N.s and especially M.D.s get arrested for impaired driving all the time, they are not immune to the effects of the drug just because another person in their profession wrote a note (script) for them

There are far too many misconceptions as to what's legal, what isn't, what the police can and can't do, etc. You need a good attorney.

5. Sifting
through the OP I'm left with one question, was he driving while under the influence of the Ambian? We loose 2 or 3 college students a year where I live because of drunk drivers and people under the influence. One time we lost 5 in one accident. Your husband is an R.N., he should have known better. There really can be no reason he would need to drive after taking the Ambian, not one excuse.

You may feel targeted based on some of the things in your post but the bottom line is your husband should not have been operating a motor vehicle while under the influence. Sorry for my bluntness but it'll be easier just to accept responsibility. The prisons are already full of "innocent" people.

person has contacted me and let me know that it would be best not to discus this in a public forum. Please contact me privately if you have any support. He was not driving after taking Amian. He just finished working. Thanks.

Get a lawyer.

but I know you are telling the truth. Why? Because of what they did to me and what they did to my partner. If I told you what they did to us, no one really believed it happened. You would. It was even worse than this. People just don't believe what they do until it happens to them. Rodney King had it worse than both of us. He had his abuse videoed and they STILL blame him and make up fairy tales to absolve the cops who abused him. That's what they do, but I know you are telling the truth. It happened to me what's happening to you. It happens every day.
