Wilson's statement on Rove News
Statement of Christopher Wolf, Proskauer Rose LLP, Counsel for Ambassador Joseph Wilson and Valerie Plame Wilson
We have become aware of the communication between Mr. Fitzgerald and Mr. Luskin concerning Karl. Rove's status in the criminal investigation. We have no first-hand knowledge of the reason for the communication or what further developments in the criminal investigation it may signal. While it appears that Mr. Rove will not be called to answer in criminal court for his participation in the wrongful disclosure of Valerie Wilson's classified employment status at the CIA in retaliation against Joe Wilson for questioning the rationale for war in Iraq, that obviously does not end the matter. The day still may come when Mr. Rove and others are called to account in a court of law for their attacks on the Wilsons.

how happy some DUers appear to be as a result of this announcement. I would prefer, of course, that Mr. Rove was indicted. I was under the impression that Mr. Fitzgerald was moving towards an indictment in mid-May. That did not happen, for reasons that we could only speculate upon. Rather than do that at this time, I'll just say that I have faith in the ability and judgement of Mr. Fitzgerald. I think that the most recent court documents indicate that he is aware that the people who are most responsible for the operation to damage Joseph and Valerie Wilson were located in the Office of the Vice President.

IIRC, for the leak charge to stick in criminal court, isn't there a provision that the leaker was operating out of malice?

I think Rove got played by OVP. Maybe, just maybe, he gave up a bigger fish. The planners would be the ones acting out of malice while Rove was just the mouthpiece.

In civil court that wouldn't matter, would it? Simply that his actions caused irreparable harm to Valerie Plame and her career.

54. The rules for
civil court are indeed different than criminal court. Perhaps the best example that people are familiar with involved OJ Simpson. It will be interesting to see if the Wilsons file suit. Whatever they decide is fine with me .... but it surely would be nice to have more information on Karl's participation in the scandal become part of the public record.

The old-timers on DU know that from the beginning, a core group of us have recognized that the Plame scandal came from the Office of the Vice President. It is part of the war program. Rove played a role, but this is a neoconservative operation. I know that democrats would like Rove indicted -- I sure as heck wanted him indicted, too. But the two most important people remain Libby and Cheney.

My theory is that if Rove will truly not be indicted on anything, lying to feds, lying to grand jury, obstruction, it would most likely be because he gave up a bigger fish, none other than Darth Cheney. I hope - I hope - I hope - Ihope. :toast:

However, Luskin's little announcement smell a bit fishy to me. Time will tell.

And if it indeed is true, the discovery process in the case of Plame-Wilson v. Rover will be quite yummy in itself. :popcorn: :toast:

you go right ahead. He still may get something on shrub & dead-eye, doesn't look good though.

But, between the truthout disaster (they were played like fools), the absolute stealing of the presidential elections of 2000, and 2004 with no one stopping them, and the incredibly evil invasion into Iraq that has cost this country not only it's pride, but half a trillion and thousands of lives, and shrub being allowed to stay on vacation while people were dying in NOLA - I don't have any faith left in the bushco collective being held accountable when they've gotten away for this long already... I was not a happy DU when I saw the news today - can't imagine why anyone would be happy.

I don't have faith and judgement in hardly anyone in this country anymore... my faith is reserved in only one thing.

I still believe Feingold, Conyers, Gore, Edwards, and Clark are extremely honorable men, and I pray that one of them will run for President and have such a huge lead in the polls that it can't be stolen without a revolution being the result of the theft... O8)

News repackagers and rumor-mill sources and blogs with a left slant are proving to be less reliable than "MSM" :eyes: (or, more accurately, "corporate media") when it comes to accuracy.

Frankly, Rawstory isn't really a site that I go to for cutting-edge breaking-news journalism. That's where you go for "news" that CNN is reporting something, hype, rumors, banners and pop-up ads.

... I've never been impressed with Rawstory. That site and its contents have always struck me as being little more than a Drudge imitator, and still not doing THAT very well either.

My observations were made long ago and my opinions were solidified LONG before the TO/Leopold debacle. The two things are not related. Whenever someone tries to link my pre-existing opinions of Rawstory as being the result of the events surrounding the Leopold story... it only serves to convince me that they know they are arguing from a position of weakness.

The fact that the "writers" (bloggers? columnists? journalists?) at Rawstory have such a low tolerance to criticism speaks for itself. The fact that some of them choose to engage in personal attacks when their work is criticized does not speak to well of the writer. When you think about it, such tactics are not the route that a professional would take (well... not any writer who wanted to be taken seriously, anyway.)

Guys/gals/those unsure, I suggest we all move off of this one. There's no story here. Whether or not Rove is guilty of anything is now a piece of history. Civil suit? I highly doubt it. A case of this nature will come down to who has a better and bigger army of lawyers. My gut tells me there will be no suit against him. Would the Plame/Wilson family put their whole estate on the line for the chance that Rove's lawyers will settle? Doubtful...very doubtful.

The Wilson's wouldn't have to put up their estate to sue Karl, his estate would be the one endangered. Plus he's got to be hurting with the legal fees he's paying out the nose for now.

76. Actually legally they only have a couple months left to file a "notice of
intent" to sue dependent upon the state in which they file suit. The clock is ticking on the statute of limitations. That said, I hope they are ready and do sue. She certainly can prove damages. He doesn't have a case but she certainly does.

I have to say I am very sad for the Wilsons today. They know that Rove was directly involved in this, and it must be very difficult to see this happenening. I can't imagine how frustrated they must be...

I am also surprised at the level of vitriol against TO and Leopold. As far as I can see, Ash is still standing behind the story, or at least what he was told and how he vetted it, so I'll wait to hear from all sides before I move to condemn. Ash apparently has 'cards'... I hope they are good ones.

I also am surprised that people aren't willing to assume that JL made a mistake, and that his sources got the story wrong, too. I keep thinking of "All The President's Men" and the scene where Woodward and Bernstein are listening to Ben Bradlee tell his story about Hoover - "I screwed up but I wasn't wrong." I've heard all about JL's past. Apparently, only saints need apply to work for the press now. :eyes: Am I saying JL didn't pull the story out of his ass? No. I have no idea what went down that weekend of May. But I will reserve judgement until I hear all sides of that story.

As far as I can tell, we have comments from a lawyer, without confirmation from Fitzgerald, to go by for this mornings insanity. I'd prefer to see the letter to Luskin that was talked about in the NYTs.

I want justice done. I want the truth served. I want to see the bastards that committed these crimes in jail. Isn't that what we all want?

I also think it's important to note that Fitz did not end the grand jury investigation by electing to not prosecute Rove. Verifying what we all knew, that the Plame investigation is a whole lot bigger than little Donald Segretti's protege.

But it would still be great to see Pigboy pay through the ass. Go Joe Wilson!

here in topsy-turvy Murka, a smart fellow like Joe should know that one does not assail the royalty or their courtesans.

Indeed, Joe and Valerie should apologize to all Murkans. Their persecution of our glorious king (who, after all, was appointed personally by Jesus Christ) is an insult to all of us.

Rove will get his due in good time. If not on this issue, it will be another. The guy is a professional criminal. He didn't get where he is by being stupid.
Think about Capone. For all the crimes he committed, he was convicted for tax evasion. Like everyone else, I'd like to see Rove screwed royally for all the things he has done, and I believe some day he will be convicted for something. It just might not be one of the worst things he's ever done.
