Durbin On Record: Thinks we've got 41 votes against the Alito nomination!
CALL FOR A FILIBUSTER AGAINST ALITO

Sen. Dick Durbin (D-IL) is on record as having stated that he thinks we've got 41 votes against the Alito nomination.

Various activist citizen lobbies maintain toll free numbers so you can lobby your own senators on this issue. Call the Capitol Switchboard toll free and ask for your senator's office (both of them, one at a time, and if you live in a Republican-controlled state, even better yet):

Need a good argument? Here's one: Samuel Alito throughout his professional career has demonstrated that he'll say anything and do anything to get the job he's interviewing for. He'll lie (if his testimony to date is to be believed), he'll cheat (taking the opposite view of his testimony on the bench, just as he has as a judge writing stinking dissenting opinions), he'll steal (by taking away our constitutional rights). After all, it's the new Republican Way.

are we saying "will vote against cloture?"

41 voting against Alito doesn't matter. A simple majority is sufficient to confirm the nomination.

41 votes against cloture will, however, kill the nomination and compel the Repig senate leadership to trigger the "nooookyuler" option, if they have the guts.

Just looking for some clarification on the OP.

for example, Feinstein reportedly has declared that she will vote against confirmation, but will not support a filibuster. I suspect she's not the only one.

5. That was my concern
When we allow mugwump dems to say "Well, I'll vote against him," but don't hold their feet to the fire about cloture, we set ourselves up.

I'm not satisfied to lose with a strong "No" vote, and neither should any of us.

Some misinformed folks may have wasted some otherwise fine efforts on begging democrats to vote against Alito. We don't need that. The Repig majority is sufficient to put Alito on the bench.

What we must demand is support for a vote against cloture. That's the filibuster, plain and simple. If Feinsetein, for instance, won't vote against cloture, then she needs to be told to go ahead and vote for Alito and quit jerking the progressives' chain.

As Liberals, Democrats, Progressives, we're idealistic, not stupid.

7. She didn't say categorically
that she would not support a filibuster. Things have changed somewhat since she made this reference 10 days or so ago. She has learned that a lot of her fellow Dems (being pushed hard by their constituents) are dead set against confirming Alito on the grounds that doing so would have the effect of removing the checks and balances, stripping the legislative branch of its constitutional powers and handing all the power over to the executive branch.

Keep the pressure on her.

on the table! The ONLY reason they are excited about having the magic number 41 is because it takes 41 votes to defeat cloture. Sounds like the filibuster is ON. :bounce:

As my post indicated, it had been reported that she wasn't supporting a filibuster. Happy to hear that report may not be accurate!!

17. When she made her first statement, it was looking hopeless. She said
that she did not think that there would be a filibuster, not that she was dead set against one. By last Friday, her office was saying that everything was on the table. Please help correct this misinformation wherever you see it.
And be on the lookout for a lot of attempts at disinformation in the days ahead.

16. That is the last that I heard... Noone would care if the 41 votes we had
we had were only againdt Alito and not for the filibuster. The Reason that 41 is important is because that is what it takes to sustain a filibuster. If this was not the aim all along, there would have been no reason to delay the vote for a week. The delay was to get enough support for the filibuster...Keep calling and faxing...ITS WORKING.

10. 14 miners die in 3wks, this country doesn't need a pro-corporatist on the
Supreme Court ruling AGAINST workers, their safety, and AGAINST consumers.

There are enough pro-corporatists on the court already. Workers and consumers need representation.
