Robert Byrd's statement on why he's voting for Scalito
"It is time to establish an end point" in the debate over President Bush's selection, Frist, R-Tenn., said.

If confirmed, Alito will be replacing retiring Justice Sandra Day O'Connor. His swearing-in could come within an hour of confirmation.

Earlier Thursday, Alito picked up two new Democratic supporters, Sen. Robert Byrd of West Virginia and Sen. Tim Johnson of South Dakota. They join Sen. Ben Nelson of Nebraska, along with 52 Republicans, who have so far publicly pledged to vote for the conservative judge.

"His obvious intelligence, his obvious sincerity lead me to believe him to be an honorable man, a man who loves his country, loves his Constitution and man who will give of his best," Byrd said.

Some years ago as an American History teacher of high school future citizens, I
procured bulk copies of the pocket constitution for my soon to be student voters. I
was so naive that I got them per my own expense rather than contacting YOU whom
I now suspect has an inexhaustible supply.

I truly think that the Alito nomination (with his bizarre "unitary executive" theory
threatens our balance of powers as outlined in our "sacred" document which I hold
so dear.

On this issue alone, we need to go the dreaded FILIBUSTER route to save our
republic. If lovers of the Constitution go down, history must record who went down
FIGHTING.

I have NEVER written my concerns beyond my state, and am choosing YOU due to
my respect for your dedication to the Constitution.

This is the most important action in your distinguished career.

Well, Byrd can tell his great grandchildren he was around when congress held the last vote for which Alito gave a shit. After this, Sammy could care less what the Hill votes for, or doesn't vote for, or votes directly against.
