Raw Story Read Fitz Letter Incorrectly, Pertinent Evidence Missing!
Edited on Wed Feb-01-06 10:33 PM by usregimechange
Raw Story reports: "In the letter, Fitzgerald admits that he has been told some emails from the President and Vice President's offices have been deleted, though he cautions that "no pertinent evidence has been destroyed."
http://rawstory.com/news/2005/Fitzgerald_admits_White_House_may_have_0201.html

But that may be an incorrect reading of Fitzgerald's letter.

1) Notice the strong wording "In an abundance of caution..."
2) Notice it preceeds the statement that "we are aware of no evidence" that has been destroyed that pretains to Libby's charges.
3) That Fitzgerald is aware of no evidence that has been destroyed appears to be separate from his warning that e-mails have been deleted. It is like saying, "I don't know if you stole from the store but items are missing and you were the only person working that shift."

1. It sounds to me from Fitz's letter that he is a man who
knows what he's doing, and that he's a man with a big fat file box full of stuff that will NOT bolster the Bush administration's reputation for ethics adherence.

Git 'em, Fitz.

5. Text:
"In an abundance of caution, we advise you that we have learned that not all email of the Office of Vice President and the Executive Office of the President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system." Special Counsel Patrick Fitzgerald, US Department of Justice.

6. Look carefully - Fitz did NOT say it was deleted

He said: "not all email of the Office of the Vice President and the Executive Office of the President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system."

How would Fitz could know that mail is missing? Well, what if it was not deleted but archived somewhere else other than the "White House computer system", like maybe a remote computer or a laptop that somehow wound up in Fitz's hands?

The Nazis kept meticulous records of their concentration camps and executions. Crazy, but that's what they did and thankfully so because it led to many of them being caught.

What if the WH crooks didn't want to completely delete the mail so they would at least have somewhere to look in case they were really in hot water and needed to explain things but thought they'd outsmart everyone by moving them somewhere else?

9. Could they know if archived to disk?
Edited on Wed Feb-01-06 11:11 PM by Jersey Devil
After archiving mail to a disk, can't they simply clean the logs and wipe free disk space using programs as simple as Window Washer that clean even beyond NSA specifications?

13. It does seem he must have them
or he would not have been able to state what he did in his letter. At the minimum he must know they were archived but the archives were not made to the WH computers.

7. I think you are right.

And, I think Fitz will get them.

He is a consumate professional and brilliant. When I watched the press conference he gave when he charged Libby, he was amazing. I know we are all chomping at the bit for justice to be done. But, slow and steady wins the race. I feel much better knowing that his guy takes his time and covers all of his bases.

He is going to get Rove.

I bet he even gets Cheney.

He is not known as the Irish Alligator for nothing!

The worm is turning.

11. Since he knows for a fact that emails were deleted...
Then he also knows they existed and knows how to retrieve them. His "abundance of caution" comment, IMHO, was CYA'ing just in case there's anything else floating around that he didn't catch. He has them dead to center on the emails. :D

16. Gonzalez and Card have to be sweating bullets
over the explanations of why the staff was not officially informed of the leak investigation for over an hour after they were informed of it. If those emails correspond to that time they are cooked geese.

15. I am hoping for more than that
Reading his language very carefully he seems to be saying no "pertinant" evidence was "destroyed" but such evidence is missing from WH computers and may have been backed up somewhere other than on those computers. That would mean that somehow he got his hands on it. Otherwise, how would he know it is "pertinent"?

17. Yep, that's what made me think forensics -may have lead to other locations
of data. Or recovered...
"destroyed"
