"We are aware of no evidence pertinent to the charges against defendant Libby which has been destroyed," Fitzgerald wrote in a letter to the defense team.
....
But the prosecutor added: "In an abundance of caution, we advise you that we have learned that not all e-mail of the Office of Vice President and the Executive Office of the President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system." His letter was an exhibit attached to Libby's demand for more information from the prosecution.
....
The only way this is possible is to destroy the daily backups. This is the whitehouse, they are going to take daily full backups of the communications systems; that is where they are shining us on. A full set of tapes or drives would not be stored at the whitehouse, that wouldn't be the safest place for them. If they are destroyed, lost, or for any other reason information removed off it didn't happen by whoops it happened on purpose. They have to go to them to do it.

2. One thing to keep in mind...
... in relation to this is that it became common knowledge that the White House had backups for its email system (at a time when most people didn't know what email was) during the Iran-Contra hearings. The WH didn't have direct control of that system--it was controlled from outside the WH. That was how investigators managed to retrieve electronic copies of emails that Ollie North and others thought that they had managed to destroy.

It's entirely possible that as a result of that, the Reaganites or the first Bush administration (or the Clinton admininstration, for that matter) had their email system reorganized to put it under their control. This may have been the reason why almost two days was allowed from the time that the investigation was announced to the time when the AG's office formally notified the WH to preserve all evidence.
