and he's pissin' off Delay's attorney. :7 Is Delay's attorney correct? Can the subpoenas be thrown in the garbage?

Prosecutor Seeks Texas GOP Bank Records

AUSTIN, Texas - Prosecutors investigating former House Majority Leader Tom DeLay on felony conspiracy and money laundering charges are seeking bank records for the Texas Republican Party.

District Attorney Ronnie Earle issued a subpoena Thursday ordering Frost Bank to produce monthly statements and signature cards from August 2002 to January 2003 for accounts connected to the party or the Texas Republican Congressional Committee.

DeLay attorney Dick DeGuerin said the subpoenas are not enforceable because the charges are still under appeal.

"There's no setting, no trial, nothing that can be enforced," DeGuerin said. "Whoever gets (the subpoena), they can wad it up and throw them in the trash can."<snip>

2. Glad to hear it.... I wish Fitzgerald would get some action going...
Wasn't Fitz's Grand Jury due to expire at the end of January? Been waiting for another press conference WITH MORE INDICTMENTS!

Does Earle have a more honest judge than the one hearing the Libby charges who continued the gag order on Sibyl Edmonds?

But you know dick, tom has something to hide. He probably told you don't let them get those records. And just give rush limbaugh a call, he'll tell you tom doesn't have a right to privacy

6. Follow the Money
As deep throat said in "All the Presidents Men", follow the money. Whether it is cash, checks, money orders or certified checks, the bank will have a record of the deposit and who's account it went to. They will also have a record of any wire that went through the federal reserve whether it was coming or going. Ronnie Earle is on to something here. He has already subpoenaed the bank records of the defense contractor involved with Duke Cunningham. While DeGeuren has been primping and stalling Ronnie Earle has quietly gone about gathering the evidence. Even dumb people can follow a trail of money and I think that Ronnie Earle has trapped Tom Delay and Tom is to stupid to realize it.

4. I thought DeGuerin was a Democrat but now I see he's donating legal advice
on behalf of the Republican Party in addition to his paying client Delay.
