It Was Cheney!
This is one of the few times we have info on Tatel. So Libby told prosecutors he heard it from Cheney but his defense is he heard it from reporters? No wonder the guy is confused, he doesn't know who told him what and, he doesn't understand that he's been indicted for perjury and not for leaking, though I'm hopeful the day will come when FitzG. does an Earle and slams Libby with a second, espionage, indictment.

Report: Cheney told Libby of CIA identity

“WASHINGTON, DC, United States (UPI) -- A legal opinion in the Valerie Plame leak case includes new information about how I. Lewis Libby learned she was a CIA officer.

Libby, the only person charged so far, told prosecutors he heard about her from his boss, Vice President Dick Cheney, The New York Times reported.

'Nevertheless, Libby maintains that he was learning about Wilson`s wife`s identity for the first time when he spoke with NBC Washington Bureau Chief Tim Russert on July 10 or 11,' Judge David Tatel of the U.S.. Court of Appeals for the District of Columbia said.

Parts of Tatel`s opinion were not released until Friday. The Wall Street Journal sued for their disclosure after Libby was indicted. Some parts of the opinion that apparently involve the investigation into Karl Rove`s part in the affair remain sealed, the Times said.

Libby has been charged with perjury, not with leaking Plame`s identity. She is married to former Ambassador Joseph Wilson, a critic of President Bush`s Iraq policy.”

10. At risk of sounding
like a broken record, it is important to keep in mind that Scooter has a very, very talented legal team. They are going to do everything possible to produce the best outcome possible for their client, under some unfavorable circumstances. This cannot include looking out for Dick Cheney's best interests.

It looks like Fitzgerald 'leaked' some good information into the public record. Maybe to put pressure on Libby to make a deal. Imagine the information Libby could give ~ however, I doubt he'll plead guilty. His friends are raising millions of dollars for his defense and he would most likely lose that support if he did.


Otoh, as it gets closer to trial and he finds out more about what Fitzgerald knows, (weren't Wurmser and someone else already cooperating after being threatened with jail?) he may change his mind.

Bush himself is also implicated by Fitzgerald's statement that he has some of Bush's daily briefings from around the time of the 'outing'. That has to have sent chills through a few spines. Wonder what was in them?

13. Scooter might drag his feet for awhile
but sooner or later, he`ll have to choose between a long prison sentence or spilling the beans....all of them. Scooters lawyers aren`t going to let him take the fall for Cheney or anyone else. It`s their job to do all they can for him.
