1. "probable cause"?

They are going to have a tough time proving probable cause in any cases that make it to court where the surveillance circumvented FISA, aren't they? That is, if any of these cases make it to court. More likely the suspects will be deemed enemy combatants, sent to Guantanamo, and never have any chance to demand their right to a hearing.

2. That's the other part of that.... when the NSA is fishing up all

transmissions and then sorting through them based on a dictionary keyword sort, etc, they don't have a warrant or probable cause to look for anyone. When the govt says they can look at people's emails headers, etc, they are scooping up data indiscrminately and there is no probable cause.

Remember what John Dean said last week on Olbermann about the enemy combatants? That's probably what you're thinking of, too. The govt being able to conveniently deal with those whose rights were violated by stripping them of citizen's rights is frightening.
