Judge Skewers "absurd" Congress over Bankruptcy bill passage

Some healthy anger at the selling of our Democracy by our own Congressional leaders.


Judge takes Congress to task in bankruptcy case


In his ruling, Monroe said the new federal bankruptcy law is full of traps for consumers, calling some of its provisions "inane," "absurd" and incomprehensible to "any rational human being."

He stopped just short of accusing Congress of being bought and paid for, dryly noting, "Apparently, it is not the individual consumers of this country that make the donations to the members of Congress that allow them to be elected and re-elected and re-elected and re-elected."


"Can any rational human being make a cogent argument that this makes any sense at all?" he wrote.

"The people who need this type of relief aren't the type of people who have been counseling with lawyers, planning, making sure everything is right," Monroe said. "They've come to the end of their rope, and this is the only thing left to save their house, car, whatever."

Many bankruptcy lawyers, scholars and judges remain sore that Congress didn't listen to their warnings about the hardships the law would unfairly impose on people.


"If I was going to write it over with a less angry frame of mind, I'm sure I would tone down the rhetoric," he said. But, he added, "I just couldn't contain myself."


Monroe's opinion inspired Austin lawyer Randy Howry, president of the Austin Bar Association, to send it to all 3,700 members. He praised Monroe's order as "a reminder to us all that as lawyers and judges, we are the protectors of our democracy. ... We must not sit idly by as our constitutional rights are being shredded."

3. So when is one of these 3,700 lawyers going to challenge this
new law in court? I appreciate theier support of the individual, but rhetoric is only a feel-good measure that does NOTHING!

Use some of that pro-bono time and get it fixed!

Feingold never voted for ths. He voted aganst cloturee as well.

It was practically Biden's bill. Bayh, and Byrd also supported it and voted for it (and for cloture). Lieberman voted forr cloture but voted against it.

14. I don't know why this doesn't have 80 votes for greatest yet.
Congress voted to show how corrupt it is when it voted for the dreadful Bankruptcy bill.

They could have voted for relief for those facing catastrophic problems: health,divorce and other disasters, but instead chose to vote against Americans when they are most in need.

Every one of the corrupt, moral imbeciles who voted for that bill must be voted out.

They can go find work at one of their pimp financial institutions, or work it on a street corner--I care not which, but they needs must be dispensed with.

I'm talking to you, Joe Biden.

And yes, I hope at least some of the 3,700 attorneys Mr. Howry sent the opinion to take up the cause.

I am so sick and tired of the rich assholes in the country thinking that people who are infinancial trouble, or who are just at the lower end of the economic scale are lazy, system abusing scumbags.
