White House Ordered to Release Spy Papers

WASHINGTON - A federal judge ordered the Bush administration on Thursday to release documents about its warrantless surveillance program or spell out what it is withholding, a setback to efforts to keep the program under wraps.

At the same time, the Republican chairman of the Senate Intelligence Committee said he had worked out an agreement with the White House to consider legislation and provide more information to Congress on the eavesdropping program. The panel's top Democrat, who has requested a full-scale investigation, immediately objected to what he called an abdication of the committee's responsibilities.

U.S. District Judge Henry Kennedy ruled that a private group, the Electronic Privacy Information Center, will suffer irreparable harm if the documents it has been seeking since December are not processed promptly under the Freedom of Information Act. He gave the Justice Department 20 days to respond to the group's request.

"President Bush has invited meaningful debate about the wireless surveillance program," Kennedy said. "That can only occur if DOJ processes its FOIA requests in a timely fashion and releases the information sought."<snip>

Is Roberts peddling?

After a two-hour closed-door session, Senate Intelligence Chairman Pat Roberts, R-Kan., said the committee adjourned without voting on whether to open an investigation. Instead, he and the White House confirmed that they had an agreement to give lawmakers more information on the nature of the program. The White House also has committed to make changes to the current law, according to Roberts and White House deputy press secretary Dana Perino.

"I believe that such an investigation at this point ... would be detrimental to this highly classified program and efforts to reach some accommodation with the administration," Roberts said.

Still, he promised to consider the Democratic request for a vote in a March 7 meeting.

23. the timing is off here
The government will take all of the 20 days and then they will file appeals and extensions just like they did in the Abu Grahib case (although I hope these all get tossed). Anyway, Roberts said he would "consider" the Dems request in a March 7th meeting which will occur in all likelihood before this stuff is released.

But, regardless, if something outrageous comes out (I'm betting) - we'll see this whole controversy heat up again for round 2 and then hopefully the Republicans will look weak, silly, cowed and duplicious for going along with the steam-rolling, law-crushing White House.

And, when we take back the House and the Senate (pray, pray, pray) we can open it all up again anyway.

the Supreme Court will overturn it. But I do not think it is likely to.

9. Probably better that we see where Roberts and Alito stand right away.
If they back the Bush*, we can use it in the '06 elections, better yet, they might slap it to the Neocons.

2. I'm glad to hear it and that is a very brave judge.
If bush drags it out like he did with the Abu Ghraib horrifying torture photographs and videos, I hope a Whistleblowers releases the information.

When will our long national and international nightmare be over?

15. This gives us a benefit no matter what.
It shows another federal judge showing contempt for what Bush tries to withhold. These things are just accumulating on a daily basis and people are getting fed up with it. There is no good way to put a good face on this.

I also think Specter will consider this an abdication of his party. He was already strongly stating the intelligence should have closed doors examination. He is pressing on in the Judiciary. I heard him say, he is going to have six witnesses in his upcoming hearing. Three in favor and three against.

Plus, he's preparing the legislation to make Bush go FISA to get a ruling on whether he violated the constitution.

Bush and Gonzalez just keep digging and the hole is heading toward China.

WASHINGTON (AP) - Senate Intelligence Chairman Pat Roberts said he has worked out an agreement with the White House to change U.S. law regarding the National Security Agency's warrantless surveillance program and provide more information about it to Congress.

``We are trying to get some movement, and we have a clear indication of that movement,'' Roberts, R-Kan., said.

Without offering specifics, Roberts said the agreement with the White House provides ``a fix'' to the Foreign Intelligence Surveillance Act and offers more briefings to the Senate Intelligence Committee.

The deal comes as the committee was set to have a meeting Thursday about whether to open an investigation into the hotly disputed program. Roberts indicated the deal may eliminate the need for such an inquiry. Democrats have been demanding an investigation but some Republicans don't want to tangle the panel in a testy election-year probe.

21. Yup something has got to be discovered
that knocks another ten percentage points off those polls that say they don't object to the spying. When that happens, watch the Republicans line up.

And I'm telling you, you can't find a bigger pessimist than me--but I just have that feeling that something is going to blow this wide open. I just got that feeling.

This really means nothing. The WH will not incriminate themselves. These guys are professional criminals - they know what they are doing.
