Cheney in Wisconsin yesterday, bashed Feingold

Cheney bashed Feingold on his home turf last night. That's pretty classless. He was at a $500/plate fundraiser for the speaker of the WI assembly who is running for Mark Green's congressional seat. Green is running for WI governor.

But Cheney used the Gard fundraiser to defend the administration's policies. He defended the “terrorist surveillance program,” which spurred Wisconsin Sen. Russ Feingold to announce an attempt to censure Bush.

When Cheney brought up Feingold’s name, there was a smattering of boos. “Don’t hold back,” Cheney said, and when he mentioned Feingold again, the boos sounded unanimous.

The president is acting within his constitutional and statutory power with the program, Cheney said, and it is subject to constant reviews to ensure civil liberties aren’t violated.

“This outrageous proposition that we ought to protect our enemies' ability to communicate poses an extreme test for our Democratic leaders,” Cheney said. “But the American people have already made their decision, they agree with the president.”

Um, if I'm not mistaken, the American people do NOT agree with the president. Am I missing something here?

And the NSA program was NOT "lawful," or "within his constitutional and statutory power."

Show me where in the Constitution it says, "The President may ignore the 1st, 4th, 5th and 6th Amendments, along with the provision for habeas corpus, when he feels like it after creating a phoney-baloney perpetual 'war.'" For some reason I can't find that provision.

Can any of the lawyers on DU help me find it?
