Investigation closed

The Occupational Safety and Health Administration closed an investigation into the falling death of Shine's Volunteer Fire Department's fire chief, a representative said. Shine Fire Chief Tully Layden, 52, fell to his death while repairing a Mulberry Street roof on April 3. OSHA spokeswoman Dolores Quesenberry said because Layden was a part-owner of the company doing the repairs, it falls outside OSHA jurisdiction. "There has to be a boss-employee relationship there for us to investigate," Quesenberry said. Firefighters and emergency officials on the scene of the accident called the fall a "freak accident."
