In a broadly worded legal opinion, the Justice Department has concluded that President Bush's former top lawyer, and possibly other senior White House officials, can ignore subpoenas from Congress to testify about the U.S. attorneys affair.

The three-page opinion raises questions about whether the Justice Department would prosecute senior administration officials if Congress voted to hold them in contempt for not cooperating with the investigation into the firing last year of eight top prosecutors.

The opinion was prepared this week by the department's Office of Legal Counsel, in response to questions from former White House counsel Harriet E. Miers, who was subpoenaed to testify Thursday before the House Judiciary Committee. Miers told the panel in a letter faxed Tuesday night that she would not be appearing, citing the Justice memo and advice from the White House.

6. Gonzo has another Taylor installed as temporary head of DC DoJ
That Taylor will oversee any case brought up by Congress against the WH.

Which is what that clause in the Patriot Act was all about. Put a Gonzo verified bushie in charge of anything the Congress might do.

4. Impeachment truly is the last option available to Congress.
They cannot depend on any other division of government to do their jobs, since Bushco has destroyed all of them.

Congress must use the tools it has available to them, without depending on anyone else.

That leaves...impeachment. Put it on the table, Nancy. It's a reflection of you, now, not just the Republicans. Why are you covering up their crimes? Are you involved somehow?

Do your job, Nancy. Impeach!

5. There's no hope if Congress doesn't step up now. Right now.
It's long past time for the Dems in Congress to stand up and defend our Constitution with real actions instead of "strongly worded letters!" or "dismay!" or "shock!"

These days will be seen as pivotal in our country's history - did the Dems save our government or did they stand down and allow the fascism to bloom right in front of them.

7. Hello democrats in Washington. You can't really legislate or
or hold hearings on a renegade executive branch in a consttutional crisis to be effective. You have to IMPEACH like the originators of the constitution would want you too. Hello? Is there anybody out there?

11. if the DoJ refuses to respond to a congressional call for enforcement
then the Rubicon has been crossed (ok, it's been crossed several time already, but REALLY REALLY crossed) and the Congress has an obligation, like the first officer on a ship with a madman for captain, to take action to save the crew. Not a political thing, not debatable. Absolutely mandatory.
Of course the first officer hesitates, hopes they can get to port and out of danger peacably. But at some point, it becomes necessary.

The Founding Fathers knew they would be hanged if their revolution failed. They proceeded.


Impeachment may not be sufficient. You can't impeach the entire administration. We need a distinct, overt, emphatic act. Impeachment is ponderous. Inherent Contempt may be the more expedient. Send the Sergeant at arms to arrest not only Miers but also Gonzales. Round them up. Invoke the damned patriot act if you have to, declare them enemy combatants. They are, after all, assaulting our government.

haven't they? here i am just a grunt a single mother watching the cost of living rise above my capability to meet it, reading DU and watching CSpan, and my frustration level is at a historic level. where is the power to stop all the wrong?
