NYT op-ed, by Anita Hill: The Smear This Time
The Smear This Time
By ANITA HILL
Published: October 2, 2007

David Suter

ON Oct. 11, 1991, I testified about my experience as an employee of Clarence Thomas’s at the Equal Employment Opportunity Commission.

I stand by my testimony.

Justice Thomas has every right to present himself as he wishes in his new memoir, “My Grandfather’s Son.” He may even be entitled to feel abused by the confirmation process that led to his appointment to the Supreme Court.

But I will not stand by silently and allow him, in his anger, to reinvent me.

In the portion of his book that addresses my role in the Senate hearings into his nomination, Justice Thomas offers a litany of unsubstantiated representations and outright smears that Republican senators made about me when I testified before the Judiciary Committee — that I was a “combative left-winger” who was “touchy” and prone to overreacting to “slights.” A number of independent authors have shown those attacks to be baseless. What’s more, their reports draw on the experiences of others who were familiar with Mr. Thomas’s behavior, and who came forward after the hearings. It’s no longer my word against his....

***

Regrettably, since 1991, I have repeatedly seen this kind of character attack on women and men who complain of harassment and discrimination in the workplace. In efforts to assail their accusers’ credibility, detractors routinely diminish people’s professional contributions. Often the accused is a supervisor, in a position to describe the complaining employee’s work as “mediocre” or the employee as incompetent. Those accused of inappropriate behavior also often portray the individuals who complain as bizarre caricatures of themselves — oversensitive, even fanatical, and often immoral — even though they enjoy good and productive working relationships with their colleagues.

Finally, when attacks on the accusers’ credibility fail, those accused of workplace improprieties downgrade the level of harm that may have occurred. When sensing that others will believe their accusers’ versions of events, individuals confronted with their own bad behavior try to reduce legitimate concerns to the level of mere words or “slights” that should be dismissed without discussion.

Fortunately, we have made progress since 1991. Today, when employees complain of abuse in the workplace, investigators and judges are more likely to examine all the evidence and less likely to simply accept as true the word of those in power. But that could change. Our legal system will suffer if a sitting justice’s vitriolic pursuit of personal vindication discourages others from standing up for their rights....

I think it was a Rethug. It was the perfect example of self-serving sexism and politicking. In an all-male hearing, it was particularly outrageous, since few if any of these men had ever been victims of such harassment and some may have been perpetrators, all in denial.

33. Thomas is a delusional bitter angry old man with a grudge.
Edited on Tue Oct-02-07 08:35 AM by BREMPRO
He claims he was "high tech lynched" by left wing activists. Perhaps understandable as a self preservation defense then, but to bring it up in such a public and central way 16 years later and claim Anita Hill was a plant by "lefties" to undermine his reputation and nomination, reveals the serious problem with his judicial temperament and character. We've all put behind us this lie, and focussed on his judicial record and lack of intellectual nuance. But he apparently is at core a bitter and angry man and more of a racist than his detractors, not a good temperament for a supreme court justice. He was clearly a conservative trojan horse nomination, using the race card to mask his radically conservative views. But The core problem is not that he's a conservative, it's that his judicial vote is heavily influenced by his anger and bitterness toward the left, compromising his judicial objectivity.

Add him to the must impeach list!

They were waiting but he decided not to call them, turning this into a he-said, she-said.

It's fascinating that Thomas has revealed himself to be mean, petty, angry, and resentful. These are not healthy emotions and they seem to be planted deep within him. He should leave the Court and go into therapy, seek meditation, and try to find some peace. But above all, he should leave the Court. Now.

However, he was in charge of the process and made it about himself in the hearings.

A tainted, bitter old man trying to drag Hill through the mud again, as if your confirmation "victory" will never have an asterisk with her face embossed on it next to your name in the history books.

Hill is wrong on one count: Clarence could have been impeached for his decision in Bush V, Gore. So much for him "belonging" on the Supreme Court.

Other then that, I'm glad to see Ms. Hill standing against that bastard.

>The question of whether Clarence Thomas belongs on the Supreme Court
>is no longer on the table — it was settled by the Senate back in 1991.

...just that the question was no longer on the table, and that its place on the table was settled (albiet the wrong way-JHB) by the Senate.

62. I was against Thomas from the beginning
I took a lot of heat for it. Still, I stood my ground. I didn't care what Jessee, Sharpton, or anyone else said. I didn't like him from the start. He knew little about case law. He knew next-to-nothing about Supreme Court precedent. The last straw was when he said there's no racism in America. Then, when Anita Hill accused him of sexual harassment, suddenly he was the target of a "high-tech lynching". The great Thurgood Marshall said (paraphrasing): If I'd known that's who they would nominate, I never would have retired.

71. My mother changed registration from Rep to Dem b/c of Anita Hill
She saw the hearings, and said "you can just tell that woman is telling the truth". She thought the Senators and others who didn't believe her were "disgusting".

She went out shortly afterwards and changed her voter registration so as not to be associated with their party.

94. I remember the first trials
And now, in retrospect, the fix was already in with the media. They persecuted Anita Hill like she was a call girl back then, and it was disgusting.

The only thing good that came out of all that shit was that sexual harassment was pulled out of the dark and into the very bright fluorescent light of the workplace. I personally dealt with an asshole I worked with about 1989--I had to leave that office because this one guy was getting too familiar with not only me, but several of the women there. The Hill testimonies put a name to all that frustration we felt.

I only wish there had been more outrage earlier in our history on this subject, but I guess it was never relevant.

98. Speaking of Prof. Hill's "courage" as many have . . .. I think it might still be
dangerous for her to speak out.

Many know that they tried to viciously lie about her and her employment --

Prof. Hill was also at some University -- as I recall it and this is a long time ago --
and Bush appointed someone to it and Prof. Hill was quickly out.

Obviously, her career has suffered -- where otherwise she might have been in a high position in government.

I didn't get to see the interview -- and hope that she is happy in whatever she is doing?

100. I'm a life long true believer in Prof. Hill
I knew Professor Hill when she was at the University of Oklahoma. I knew her before the hearings and I knew her after. I believed her then and I believe her more today.

She is a Woman of great courage, strength, and integrity. I watched her bear the scrutiny and scorn of the ignorant multitudes with grace, dignity and nary a complaint.

Her reward was losing her job and her anonymity which I know she'd have preferred to keep.

She has persevered and made the best of her life in a world that is far from her home and loved ones but fortunately values her wisdom and experience.

Here's a little tidbit that may surprise many: she's got a wonderful sense of humor and delightful laugh. Throughout her ordeal, she never lost her ability to laugh at the absurdity of the world.

I went with her and a group of faculty and students from the OU law school to see "Dave"---the Kevin Kline movie about the accidental president. I can still hear her uproarious laughter at the pomposity of the Senate hearings scene. The group of us laughed with her at the bizarre irony of her watching a reflection of her life on the screen and the joy of being able to see the humor in that deliciously odd moment.

When I read the Times Op-ed peice, I was glad to see time had not swayed her ability to speak truth to power.

Professor Hill is a shining example of what is great about America.

Edited on Tue Oct-02-07 09:37 PM by defendandprotect
She's a wonderful person and I hope that there is not a new onslaught against her --
these are vicious people.

I haven't watched any TV on this -- I didn't realize that I missed an opportunity to see Prof. Hill... I'd liked to have seen her -- and heard her.
I think many females feel close to her because of what she brought to light and I think it did help America and help women.

If this thread is any example at all, all the world admires and believes Prof. Hill --

Clarence Thomas on the other hand continues to be disdained --
not just for his sexual perversions and lies.
Our Supreme Court is an embarrassment --

and a danger to America and the ideals of democracy.
