Woman Sues Apple Over IPhone Price Cut

A New York woman is so angry at Apple Inc. for lopping $200 off the price of the iPhone that she's filed a lawsuit seeking $1 million in damages.

Dongmei Li of Queens, N.Y., claimed the company violated price discrimination laws when it slashed the price of the 8-gigabyte iPhone by a third, from $599 to $399, within two months of the gadget's June debut.

According to Li's lawsuit, filed on Sept. 24 in the U.S. District Court, Eastern District of New York, the price reduction injured early purchasers like herself because they cannot resell the product for the same profit as those who bought the cell phone following the price cut.

Li purchased a 4GB iPhone for $499 and alleged that owners of the 4GB model were given less favorable terms than those who bought the 8GB model at the premium price, according to the lawsuit.

Somehow, it seems counterintuitive to penalize companies for reducing prices....The logical extension of this is that any seller could be sued for putting something on sale, because anyone who bought the item before it went on sale would lose potential profit. For instance, we could start suing companies when their stock went down, because we couldn't sell it for as much as when we bought it. Stupid.

So she bought for the going rate. Now the price is lower. So she thinks something WRONG happened?!?!

My gawd, she probably has an effing HEART ATTACK when the price of fuel drops ("call my lawyer, I was hoping to resell that gasoline!").

7. First of all, who buys a cell phone with the intention of reselling it? And second - I don't know
the legal argument, but I have a hard time believing that a company has any legal obligation to previous buyers when they lower the price of something. And finally, everyone knows, except apparently this doofus, that you will pay the most for an electronic product (and just about everything else) when it first comes out. If you want to be the first on the block to own the latest new gadget, you should be willing to pay for the privilege.

There were a bunch of a**holes on ebay offering the 800$ PS3 for 2,000+ dollars (nothing lower.)

Shortly later (a few weeks actually_ you could buy them in stores easily for the standard retail price. I hope the assclowns who pulled the 2,000+ dollar stunt got stuck with the damn things...

11. If that is what this woman was up to, I have even less sympathy for her.
Speculators simply drive up the price for people who really want the product. If they want to speculate, they should be able accept the fact that sometimes they will guess wrong. The manufacturer owes them nothing.

Apple offered $200 cash for folks who had purchased the
phone within 14 days of the price drop, so they got the
full effect of the price reduction. Everyone else got
a $100 Apple product credit for future purchases.

(I don't remember the specifics of the deal for folks
who bought the smaller, now-discontinued 4GB phone.)
