Florida Cop To Drop Suit Against Toddler's Family

A police sergeant who sued a family with a baby who suffered severe brain damage from a near drowning because the officer slipped and fell in a puddle of water at the house will drop the lawsuit, her attorney said Thursday.

David Heil, who represents Casselberry police Sgt. Andrea Eichhorn, said he plans to file paperwork to that effect as early as Friday.

The city also reported Thursday that it had placed Eichhorn on leave.

The police department would not explain why she was removed from duty. In a prepared statement, the department said it did so after a controversy over the suit caused it to review the incident.

In January, the toddler wandered into the backyard and fell into the family pool. When his mother hauled him out, he wasn't breathing. Rescuers were able to bring him back to life, but he suffered severe brain damage and cannot walk, talk or even swallow.

3. Reason for lawsuit:
The cast of characters:

Eichhorn is the cop.

Cosmillo is the family of the very young boy who fell into the pool, and consequently is severely brain damaged.

Pavlis is the police chief.



From the article:

Eichhorn arrived a few minutes later. As she stepped into the room where rescuers were working on the boy, she slipped and went down on one knee, then stood back up, according to Richard Cosmillo.

Later that day, she went to an emergency care center and eventually to an orthopedist, according to her attorney, David Heil.

While she was on medical leave, Pavlis said, the city's insurer paid her medical bills and provided disability checks.

Eichhorn, a 12-year department veteran, would not discuss the suit. Her attorney said those benefits, paid by the city's workers' compensation carrier, were not enough. The suit seeks an unspecified amount of money.

Eichhorn, he said, is a victim. Her knee aches, and she will likely develop arthritis.

If the Cosmillos had made their pool baby-proof, police would not have been called to the scene, there would have been no water on the floor, and Eichhorn would not have hurt herself, he said.

"It's a situation where the Cosmillos have caused these problems, brought them on themselves, then tried to play the victim," he said.

Could it be the officer involved violated some policy or did something negligent that contributed to her getting injured?

No way should citizens be afraid to dial 911 for fear of dumbshits like this officer suing. I give cops the benefit of the doubt in 99% of situations, but on this one, no way.

Who would want this Sergeant showing up on their doorstep after this? Answer: No one.
