Scalia's daughter charged with DUI and child endangerment
Daughter of Supreme Court justice charged in DUI

A daughter of U.S. Supreme Court Justice Antonin Scalia was arrested Monday night in Wheaton and charged with driving under the influence of alcohol and child endangerment, Wheaton Deputy Police Chief Thomas Meloni said.

Ann S. Banaszewski, 45, was stopped about 7:25 p.m. in a 1996 Ford Econoline van near Gamon Road and Longfellow Drive after a citizen reported a possible drunken driver was at the McDonald's restaurant near there, Meloni said.

Three of Banaszewski's "small children" were in the van with her at the time, leading to the child endangerment charge, Meloni said. He would not disclose their ages. Meloni would also not disclose details of her alleged intoxication, but said she submitted to a field sobriety test, though he could not disclose its outcome.

"Probable cause was established to arrest and charge the driver with DUI," Meloni said. Banaszewski was taken to the Wheaton Police Station, where she was released on her own recognizance, Meloni said. A police officer dropped her children at a family friend's home, a "common practice" when someone is arrested with children, he said.

7. the chicago land area has had over the last few weeks
horrific accidents involving drunk drivers. i`m guessing at least 15 maybe more teenagers have been killed along with a similar number of adults. so the daughter of the supreme court judge get`s special treatment-- boy oh boy this is not going to be well received in the chicago area

I don't think they wrote the DUI laws unilaterally, and the fact that Scalia's daughter was charged with not only DUI but also child endangerment suggests that the law was applied appropriately despite her father's position, so I don't quite understand your post.

43. The difference is she wasn't charged with child endangerment.
The police will call to get someone to pick up the kids when the charge is administrative. My nephew was arrested for driving under suspension (as an adult) with his teen brother in the car and the police let him call around until he found one of his uncles to come take the younger kid.

The story would have been different had he been stopped for driving under the influence with little kids in the car. It would have resulted in an immediate call to Children's Services and even if a parent came along to claim them there would still be a visit from a social worker.

39. A co-worker's sister picked up her children here in Colorado
The co-worker had been charged with DUI and child-endangerment similar to the OP. The sister was called and came to pickup the kids.

Maybe some states are different, but I'm glad in CO they don't push the children off to strangers and will allow family to come get the kids and care for them. Just because the social workers have some kind of degree does not mean that they won't be scary to the kids. They're still strangers.

No matter how old they get, you still fret over them like they were kids. You interfere less - or not at all - but you still agonize when they hurt and exult when they win.

Shit, my great-aunt still refers to my wife and I as "you kids", and we're early 60's!

I'll bet even a reptile like Tony hurts in his little three-chambered heart because of what has happened to his kid.

44. I'm over 50 and my dad refers to me as his "kid", but no one else thinks of me
that way. in any event, the better comparison would be if Ruth Ginsburg had a 45 year old "kid" who got stopped for DUI would the media treat it differently than they will treat this? I doubt it.

If you are a member of my community ... the police tend to "make arrangements" for the kids if possible. If you are NOT a resident they are not so accommodating.

I wonder what the police (there) generally do in this situation? Was she treated differently ...?

A friend's former husband was essentially allowed to drunk drive the rest of the way home (a very short distance) because he had their kids with him (one of which is severely disabled) ... that was very disturbing!
