5. So now, not only is
Kindasleazy exempt from the law, she can change the laws
as she sees fit.

Assault without physical contact?!? :wtf:

Nuisance or harassment charges at best.

http://en.wikipedia.org/wiki/Assault

Assault is a crime of violence against another person. In some jurisdictions, including Australia and New Zealand assault refers to an act that causes another to apprehend immediate and personal violence, while in other jurisdictions, such as the United States, assault refers only to the threat of violence caused by an immediate show of force. Simple assaults that do not involve any aggravation such as use of a deadly weapon are distinguished from aggravated assaults in some jurisdictions.

Assault is often defined to include not only violence, but any physical contact with another person without their consent. In Common Law jurisdictions, including England and Wales and the USA, battery is the crime that represents the unlawful physical contact, though this distinction does not exist in all jurisdictions. Exceptions exist to cover unsolicited physical contact which amount to normal social behavior (for example, patting someone on the back): see (in England and Wales) Collins v. Wilcox<1984> 3 All ER 374.

In most jurisdictions, the intention to cause grievous bodily harm (or its equivalent) may amount to the mental requirement to prefer a charge of murder in circumstances where the harm inflicted upon the victim proves fatal. In England and Wales, this fact was criticized by Lord Edmund-Davies in Cunningham <1982> AC 566.

Notice that the terms physical and violence are included in the definition.

6. well actually assault
as you've linked from wikipedia does not involve physical contact, that is a battery, technically what she did would be an assault IF a Rice reasonably was apprehensive about immediate physical unwanted contact.

Spitting can be assault, a swing and a miss, "rushing" someone, etc.

So no, the law isnt changed, assault requires no physical contact.

This is not that I am defending prosecution in this case because I am definitively not.

7. True but,
Kindasleazy was well aware of the actions of
Code Pink on the Hill. They never resorted to
physical attacks. The protestor clearly had
'Code Pink' on her shirt, identifying her as a
non-violent protestor. Kindasleazy had no fear
of physical harm that would warrant the charges
of assault based on 'fear of harm'.

Just my opinion...then again, Dad always said
I would argue with the Devil if I had a chance.

33. Assault doesn't require physical contact.
The fact that she "certainly could have if she wanted to" actually doesn't help the defense.

I'm glad this happened, and my hope would be that no charges are applied, or if applied they are beat or dropped.

But I also recognize that part of what makes non violent protest powerful is the response of law enforcement.

38. The Code Pinkers and the Capitol Hill Police probably have a...
relationship not unlike this old cartoon (from wiki)

Most of the cartoons begin at the beginning of the workday, in which Ralph and Sam go to a meadow where sheep graze, exchange chitchat, and punch into the same time clock. Work having officially begun, Ralph repeatedly tries to abduct the helpless sheep and invariably fails, either through his own ineptitude or the minimal efforts of Sam (who always brutally punishes Ralph for the attempt). At the end-of-the-day whistle, Sam and Ralph punch out their time cards, chat amiably, and leave, presumably only to come back the next day and do it all again. Both Sam and Ralph are performed by voice actor Mel Blanc. In at least one instance, the workday is interrupted by a lunch break which they conducted amiably. The operation seems to run 24 hours a day or at least into another shift, as when Ralph and Sam "punch out" they may also run into their replacements for the rest of the day, Bret and Enoch, respectively. In some of their earlier appearances Sam and Ralph are named inconsistently: in particular the Sheepdog's shift replacement sometimes addresses him as "Ralph".
