Question??If police are on your property are you allowed to tell them to leave?

Question??If police are on your property are you allowed to tell them to leave?
Deputies were in my neighbors driveway walking around her house.I approached and asked them to leave the property.They did not have any paperwork.They said they were assessing for a levy(Can someone please explain what that means).
This lead me to wonder if cops do not have a warrant do they have to leave property if asked?

This is a good question. I have always thought you could ask them to leave if they don't have a warrant, but have never had a reason to test it.
BTW the 'assessing for a levy' was quick thinking. Too bad you didn't bust out laughing.

2. I don't think you can order cops off someone else's property.....
something about your not having legal standing to do so, I think.

Also, I'd think twice about "ordering" cops to do anything. Remember, THEY have the guns. All they have to do is shoot you and claim you reached into your clothes like you were drawing a weapon and they would suffer NO consequences and you'd be quite dead (can you tell I live in LA?).

or at least to ask the owners permission. But that was before Bush destroyed America.

11. Not true
Cops can enter a property if they have a reasonable basis to believe that either a crime is taking place, or that there is evidence there that might not be there by the time they get a warrant. I believe it's called "exigent circumstances"

and I wasn't nice about it either.

And he left.

And I was not shot.

He was a county cop from the valley. I have nothing against 99% of Tennessee cops. Most I've met or dealt with are fair and decent human beings.

But this one thought he would escort a Tennessee Drug Tax dude up to the mountain. Guess the tax guy (from Nash Vegas - all decked out in bulletprooof vest) was askeered to come up here by himself. He was looking for a kid who no longer lives here.

He wants the kid to pay a $3000 dollar tax on $60 worth of mushrooms the kid already spent thirty days in jail for and is paying the courts and a lawyer for...

They both woke me up before a long shift at work and I reamed both the SOB's out. They got a ComeToJesus frothing at the mouth from me about the Drug Laws and the poverty they produce and the unconstitutionality of the tax law. The last thing i said before I walked back inside:

"The kid was on Work release and got his asshole examined EVERY day by guys your age. Let me ask you something...What would Jesus think about that? You think Jesus would be more upset about grown men STARING AT A KID"S ASSHOLE FOR THIRTY DAYS or about the fact he was carrying a small amount of something that grows in cow shit?"

There was no warrant. But they stood outside for a few minutes more. I went back outside and told them to get OFF my property.


"Watch it" the county dude said.

I told him if it was now illegal for a resident to express their beliefs on their own property we were in trouble.

"Are you gonna threaten a five foot tall hundred pound woman now too?" I asked. "Now THAT'LL be real manly." They left and i closed the gate and yelled at them to go catch some child molesters.

Don't take any shit, people.

They just give you more because they think you like it.....

I'm a little bitty woman and I'll tell you what I know - some cops eat up fear like candy. Show none and know your rights and throw them back in their faces.

As I read your post, I was thinking you were a guy till I got to the end!

It doesn't bother me at all to put anyone in their place anymore. I wonder how close to going to jail I have ever been......and didn't know it!

would you demand to see a court order when the firemen arrive ? I have no problem with police on my property. Their presence is a lot cheaper than a burglar alarm. They are much more welcome than some people who have squatted in my drive-way.

That story smells. They were casing their house. I've been assessed before, and it was always people from the city hall's office, never cops. That's not their job.

16. Perhaps the city filed charges against the homeowner
for non-compliance & the cops were checking it out before they filled out a warrant? People build illegal shit all the time, and then ignore notices from the city. In the fine print of the wranings, there is usualy a phrase that involves criminal charges.. :shrug:

There is no single rule on if police can ve on someone's property. It depends on the context. There are some situations where a warrent is needed, and others when one is not.

In no case, however, does a neighbor have any authority to tell the police what they can or can not do.
