Libby jury asks for flip chart, post-it notes, masking tape etc. - FDL


This morning's bit of jury news (fresh off Pacer and courtesy of reader : the jury has requested (1) a large flip chart; (2) masking tape; and (3) post-it notes. Boo yah! It's an active, detail-oriented and organized jury. Gotta love it. (H/T to reader " for sending me the PDF from Pacer. Thanks so much!)

Sometimes, you just need to strip away all the flash and razzle dazzle, and look at things for what they are at the bare minimum. Get straight to the core, to the heart of whatever it is that you are contemplating. Here's hoping that the Libby jury has an opportunity to do just that throughout their deliberations — looking solely at the facts and testimony that have been put into evidence throughout the course of the trial. The judge's staff has put together binders of copies of the evidence, along with the jury instructions and other pertinent materials for each individual juror. They will also have the original pieces of evidence to see as well.

Things like Vice President Cheney's handwriting on the Wilson op-ed from 7/6/03 — you know, the one that talks about "the wife" and junkets. And all of Libby's handwritten notes, scrawled out across lots and lots of newspaper clippings and daily meeting notes — days and days of clippings and notes over weeks of time – zeroing in on how to rebut the criticism of the Vice President and the Bush Administration and their run-up to the war in Iraq. And the lies that were sold to the American public to get us there.

1. I think we're in for a long wait
my guess is this jury will come back with a (Guilty!) verdict next Tuesday or Wednesday.

8. I think you are right. Apparently at least 2 PhD's on the jury
I don't know their disciplines but it's likely that they will want the deliberations to be something more than an emotional or intuitive shot from the hip.

6. This is exactly why I saidthe prosecution summary will win the
case for them! They did exactly what the jury is doing now. Step by step and day by day, how the events occurred. All that crying that Wells did just isn't going to matter!

11. usually in a criminal trial,
If the jury comes back quickly, it's worse for the defendant. The longer the jury deliberates, the better it is for the defendant, They are more likely to come back with a light sentence or a not guilty verdict.

However, because this is a long and involved trial, I see this as a good sign that they are taking their jobs seriously, examining the evidence carefully, and are more likely to come back with a guilty verdict. Besides, there are five counts in the indictment; they only need one conviction to send Scooter to the cooler.

And yes I am a lawyer and I used to be a court reporter, until it drove me completely nuts.
