(i'm wondering if anyone out here in DU-land has thoughts on possible "democratic action" for these people -- brook)

Orlando residents near bombing range face loss of home insurance, threat of blasts, toxins

Mike and Stacia Tatum no longer want to live in their southeast Orlando dream home -- a three-bedroom town house with lots of room for their toddler, Cody.

Less than a year after moving in, they found out their Lee Vista Square home was built on the fringe of a former World War II-era bombing range.

Since July, live bombs as well as bomb debris have been found at a nearby school, under the yards of some homes and on ranch land behind the school. Army officials are testing soil in the area for possible toxic chemicals.

Now they face another peril: The Tatums and their neighbors could lose their homeowners insurance because companies could drop or decide not to renew policies in Vista Lakes, Crowntree Lakes and Tivoli Gardens. And the homeowners have had little luck trying to sell their homes in a market already flooded with options.

The neighborhoods were built on the edge of the Pinecastle Jeep Range, and public records show that fill dirt taken from the range was used throughout the development.

Mike Tatum, a construction manager, said losing homeowners insurance would make the couple financially vulnerable. "But, God, how can we stay here? We're on a 60-year-old bombing range that hasn't been cleared by the government. There could be anything out here."

1. our gov't doesn't give a flying f*ck about US-they just want their paychecks
and health care packages

I am just one of the many 10's of thousands in the US (800 in my COUNTY alone) living on a non-tested, uncleaned, non-disclosed probably toxic, former meth lab property. Luckily lab was in shed and waste "only" poured on soil so my house is okay. I am still scr*wed.

Did they, do they know the health issues? Yes for at least the pawt 20 years...

Does our local law enforcement, public health, EPA, DTSC give a damn???
No, they collect their $50K and up salaries while people are left to figure out how to get out of these hell holes on their own.

But tons of money is given to the tweakers that are responsible for these hazmat sites...

And law enforcement is no help. One of the cooks responsible for my property only got 7 months in prison, the other got off on technicalities for two meth lab bust, did a few years in prison for a third and then was picked up recently for possession and giving Drug Court...and was just picked up again for violation of probation...

our whole system is a joke, but I am not laughing...

2. correct me if I'm wrong -- but aren't you now responsible for disclosing this toxic
Edited on Mon Jan-14-08 12:22 PM by nashville_brook
waste to a prospective buyer? Like, once you know about a contamination, you have to report it.

Reading this article about the bombing range, that's one of the issues facing the residents of Lee Vista -- they need to find evidence that the contamination and unexploded ordinance were known about and not reported.

Reading the comments to the story, I hear of lot of the same sentiment that you mention -- everyone is pissed of at the "government" and it's fomenting an everyone-for-themselves attitude. Seems like there's something to be gained through "banding together" to bring these agencies and brokers into compliance with some sort of ethical standard.

I'm very sorry to hear about your loss/difficulties with your property.

3. the sellers knew and didn't tell me-I want to rescind the contract and get my money
back. Willful fraud in real estate is not looked at too kindly here in California. The problem for me is finding $10K for an attorney to sue the b*stards that sold me the house without disclosing the former meth lab status. I can't find one that will work on contingency. It is a civil matter. Attorneys I have spoken to have told me I have a strong case and would win. The other problem is actually collecting...

I have evidence (witnesses) that the sellers knew and I have copies of the police report.

I never ever said I would not disclose it. That is not my nature. I do not want to sell it to strangers, I want to cancel the contract.
