Yesterday’s midnight filing by the White House in CREW v. Executive Office of the President, a lawsuit challenging the failure of the White House to preserve and restore millions of missing emails, raises some very troubling questions that the White House clearly does not want to answer.

The White House has now admitted that it does not have an effective system for storing and preserving emails. This is no mere technicality; it is this failure that led to the likely destruction of over 10 million email. What the White House has not explained is why it abandoned the electronic record-keeping system used by the prior administration -- a system that properly preserved White House email -- but did not replace it with another effective and appropriate system.

The White House has also admitted that the only safeguard it has to its patently inadequate method for preserving email (dumping them in files that are put on EOP servers) is back-up tape media. These back-up copies, however, are only a “snapshot” of what was on the server at the time of the back-up. In other words they are not comprehensive, as the White House concedes.

Even more troubling, the White House has now admitted that until October 2003, the White House recycled its back-up tapes, which contained the only copies of emails deleted prior to that date. What the White House has not explained is why it changed its policy of preserving all back-up tapes -- instituted in March of 2000 when the Clinton administration discovered that its system did not fully preserve all email from the Office of the Vice President -- at the same time it decided to dismantle the existing electronic record-keeping system, with no replacement at hand.

The deletion of millions of email beginning in March 2003 coupled with the White House’s destruction of back-up copies of those deleted email mean that there are no back-up copies of emails deleted during the period March 2003 through October 2003. The significance of this time-period cannot be overstated: ...................

5. What they are saying is there are no e-mails. NO surprise, but is it true?

If there were backup tapes, would they tell us now? I don't think so, or we would already have been told. NO, whether the e-mails exist or not does not matter with regard to deciding what to say now, I suspect. Evidence can no longer exist.

14. Exactly, and who did they e-mail to? Who has what e-mail where still? Unpredictable stuff
unless the originals actually still exist and you know the facts.

If the White House actually lacks copies of their own e-mails, and has no idea what evidence got out when ....... :rofl: they are stupid!

15. There are two separate email scandals:
One email scandal involves conducting official government business on the rnc.org domain - where an estimated 5 million emails were lost. Mary Ann Akers gave an update on that scandal at the end of November:

The other email scandal involves emails on the whitehouse.gov domain - where an estimated 10 million emails were lost.

10. They should be prosecuted to the full extent of the law!
Every crime they are charged with, should be treated as if those e-mails confirm the wrong-doing of which they have been accused, otherwise they would not have been erased. I am bone-weary of seeing nothing done to put these Mobsters away. The country has been hijacked and nobody seems to care.

Oh Ms. Nancy... you gonna have lots of splainin' to do unless you somehow decide that the law of the land and your oath of office supersede your lust for political power and another $10 million or so in the bank.

Oh, I forgot. It's not you. It's your astute, savvy strategic advisers who keep telling you that the American public is just dying to vote for inept, rudderless, co-opted, ineffectual, conniving, back-stabbing, lying, enabling, complicit cowards who feed at the slimy corporate trough right next to the feral GOP pigs.

Yup, that's how to get elected in this country. Play up the wimp factor, appeal to the nerds and dweebs, because all Americans identify so closely with dipshits and dorks and treacherous little Iagos. Just ride that 15 percent approval rating right into a super-majority.

Gawd I'm so absolutely disgusted with these awful "representatives." If only it weren't so hard to unseat incumbents. I'd love to see about 180 of them lose their jobs to progressives next November. I'd love to see Ms. Nancy looking lost and bewildered, but perfectly coiffed and made up and botoxed into impassivity, as she gives her concession speech while the Sheehan camp howls like coyotes and parties into the early morning hours. I'd love to watch the DLC dissolve into its constituent minerals and fluids in prime time on national TV.

If ever there were a group of faux leaders more richly deserving of being outsourced, I hope I never encounter them.
