Don't forget Barbra Boxer's "Exclusivity" Amendment for the FISA Bill
There is an amendment that Barbara Boxer wants to add to the FISA bill that is very important. It is the exclusivity provision. This one doesn't get a lot of play but you should understand its importance. It states that FISA is the only bill that deals with foreign surveillance. Without it Bush will say the illegal tapping is covered elsewhere, in other laws, all sorts of laws, and keep any chance to stop this unconstitutional encroachment on each of us in the Court for years.

Exclusivity is as important as denying immunity to the Telecoms.

2. Is the ONLY issue the Reps are fighting the removal of the retroactive immunity
portion of the bill?

Is Boxer's amendment an additional amendment? I'm confused about all of the amendments floating around.

Just heard Rockefeller urge a vote against cloture.

5. No - this one is just as important to them, maybe even moreso, but they keep it quiet.

7. No, he won't claim it's in other laws.
He'll continue to claim as he has that it's in the Constitution: Intelligence matters, it's been claimed, have been deemed to be a function of the Executive branch, a function not bestowed by Congress.

Boxer's provision can't address that claim.

Now, I'm not qualified to comment on the claim, so I won't--or on the assertion that Congress can regulate such things as it regulates free speech, for instance.
