Emory University Law Professor was on to comment about the Pentagon deciding to go for the death penalty on 6 9/11 "linked" conspirators.
The daytime host was clearly not expecting the prof to just rip into every element of this, torture, and our entire handling of terror suspects.
The prof never raised his voice but he stated something along the lines of:
He was involved in the Hamdi case and like that one the lack of due process, representation, and torture are clearly going to be a factor here
The DoD simply "doesn't have the resources" to handle this kind of cases
He mentioned that the filing were completely missing a necessary component. I don't remember what it was but he said that he was amazed that the charges didn't have a necessary legal element in them.
He finished with "I have every confidence in our judicial system that we can prove guilt without having to torture someone"
