Let's say you're Jack Bauer from "24" and you have a terror suspect who knows where the bomb is. You waterboard him and demand "Where's the bomb? NY or LA?" The suspect says LA. So you send your agents to LA to find and diffuse the bomb. An hour later, the bomb explodes, IN NEW YORK!

So how does waterboarding work in the "ticking time bomb" scenario?

again... resulting in a 4-4 decision and upholding a lower court outlawing waterboarding.
