You know, I was just reading over existing US Law on torture.

To me it looks like Bush himself is eligible for life in prison, and anybody who actually did the torturing is eligible for the death penalty. $100 says he ends up granting a blanket pardon to himself.

No wonder Mukasey won't call waterboarding torture; it would mean his superiors have met all the criteria for conspiracy to commit torture under (c) below.

http://www.law.cornell.edu/uscode/18/usc_sec_18_00002340---A000-.html

§ 2340A. Torture

(a) Offense.— Whoever outside the United States commits or attempts to commit torture shall be fined under this title or imprisoned not more than 20 years, or both, and if death results to any person from conduct prohibited by this subsection, shall be punished by death or imprisoned for any term of years or for life.
(b) Jurisdiction.— There is jurisdiction over the activity prohibited in subsection (a) if—
(1) the alleged offender is a national of the United States; or
(2) the alleged offender is present in the United States, irrespective of the nationality of the victim or alleged offender.
(c) Conspiracy.— A person who conspires to commit an offense under this section shall be subject to the same penalties (other than the penalty of death) as the penalties prescribed for the offense, the commission of which was the object of the conspiracy.

1. We don't have to charge him until
January next year. Then he can't pardon himself. Just start impeachment hearings.

2. Not only that, but torture is an international crime
because of the Geneva Conventions. He can't pardon an international crime and he can't pardon impeachment..no one can. Someone like the House Judiciary committee needs to push the button and get the impeachment hearings in motion.

5. "We do not Torture." GW Bush.
The US Govt. only allows Enhanced Interrogation.

Methods used at GITMO
1.Prolonged sleep deprivation,
2.Sensory deprivation,
3.Extremely painful "stress positions,"
4.Sensory bombardment (such as prolonged loud noise and/or bright lights),
5.Forced nakedness,
6.Sexual humiliation,
7.Cultural humiliation (such as desecration of holy scriptures),
8.Being subjected to extreme cold that induces hypothermia,
9.Exploitation of phobias,
10.Simulation of the experience of drowning and controlled drowning, i.e., waterboarding.

8. Your list is really insidious. Each item is a torture that does not bruise or cut.

It's like Disney torture. Family friendly torture.

6. But Only Impeachment Can Bring This Justice
If they fail to impeach, no court will charge/convict -- as the torture/war crimes have been "approved" by Congress.

That's just the political reality of it.

They'd all still be vulnerable to being abducted/charge/tried internationally -- by anyone. But that's not too likely. Nor does it do anything to Redeem Our National Soul (and reinstate our moral place in the world).

Impeachment is our ONLY moral, patriotic option.

7. Even if he is never tried
We, as a moral stand, should make sure he can never set foot in public again without a hail of rotten food thrown at him.
