New Hampshire Has Impeachment Fever
New Hampshire State Representative Betty Hall is the chief sponsor of a resolution to be voted on this week in the state legislature, a resolution to petition Congress to impeach Bush and Cheney. Hall asked people to Email her their thoughts, and she is receiving more than one Email per minute, almost all of them from New Hampshire, but some from other states and countries, and every single one of them supportive of impeachment. Here's a sampling:

I ask that all House Representatives pass House. HR24 approving of the petition and have it transmitted to Congress as a directive from the State level to the U.S. Congress to commence Impeachment Hearings post haste. This vote will take place either 3/5 or 3/12 in Concord, and we ask that ALL the House members vote for HR 24 and be our voice in Washington. We have been waiting too long for this to take place. my understanding is that once a State legislature pass an impeachment petition the US Congress MUST follow through, they have no choice.

That would also be Unconstitutional. The house has the sole power of impeachment. THe Senate has the sole power of trying impeachments. The states are voiceless in the process beyond their own Reps or Senators. This is totally useless to any real impeachment proceedings. The states need to start passing impeachments of any House Members not demanding and backing Impeachment of Bush & Cheney. When the House see's members disappearing only to find out that they were impeached by their constituency for not backing impeachment. THEN and only then will impeachment be on the table, be on the tip of every tongue in DC, and be on every front page. Until then. It's no skin off their ass and it won't get done.

The proposition must be someone is getting impeached. It's either Bush and Cheney or you. Right now the decision is yours. But it won't be for very long. So do you want to do the impeachment there or face the impeachment here?

17. what other STATE legislation has actually passed a resolution?
I know several have talked about them but never acutally passed one. There IS a clause in the constitution that allows the States to pass and petition the Congress to begin proceedings. It has been talked about here before. Several lawyers have posted talking about it.

18. You can petition Congress for a redress of grievance. But that doesn't tie their hands.
If it did then they would not have the "sole power" of impeachment. Even with a petition from a state legislature. They can refuse to begin impeachment hearings. It's entirely their call. I'll have to look up the states that have passed impeachment resolutions.

This is a good site on the issue.

Your right Vermont is the first state to pass impeachment. 10 other states also have impeachment resolutions pending. But I still don't think this will compell the House to impeach.

20. Check out Section 603 of the US House Rules regarding impeachment....
Section 603 of the United States House Rules provides for the inception of impeachment proceedings in the House of Representatives "by charges transmitted from the legislature of a State."

Section 603 states, inter alia:

"Inception of impeachment proceedings in the House.>> House of Representatives there are various methods of setting an impeachment in motion: by charges made on the floor on the responsibility of a Member or Delegate (II, 1303; III, 2342, 2400, 2469; VI, 525, 526, 528, 535, 536); by charges preferred by a memorial, which is usually referred to a committee for examination (III, 2364, 2491, 2494, 2496, 2499, 2515; VI, 543); or by a resolution dropped in the hopper by a Member and referred to a committee (Apr. 15, 1970, p. 11941-42; Oct. 23, 1973, p. 34873); by a message from the President (III, 2294, 2319; VI, 498); by charges transmitted from the legislature of a State (III, 2469) or Territory (III, 2487) or from a grand jury (III, 2488); or from facts developed and reported by an investigating committee of the House (III, 2399, 2444)."


This means that is NH DOES pass the impeachment petition the House MUST deal with it. We've been waiting for some state to have the stones to do it.

21. House rules do not trump the Constitution. The Constitution does not give them the ability to
provide for by law. It gives them the sole power. Bush could challenge the impeachment before SCOTUS. Saying that impeachment must originate in the house. Not a state legislature. This is the only way for the House to have the sole power of impeachment. This is something the House must do themselves. They can't delegate the duty to other enities. Don't think they won't make that case. They will challenge every undotted i and uncrossed t. Oh hell they will erase the dots over i's and croses on t's and challenge them.

22. you're misunderstanding this
the impeachment WOULD originate in the House.......the state legistature petition means the HOUSE would have to commence proceedings. The HOUSE WOULD STILL BE THE ORIGINATING BODY TO COMMENCE IMPEACHMENT. This just forces the House's hand. They MUST act on it. Bush cannnot challenge any of it. It is the same as if a House member brought the resolution. The state is NOT the one originating the resolution the US HOUSE originates it but the State forces the US HOUSE to act.
