'Gilligan's' Mary Ann Caught With Dope

Dawn Wells, who played Mary Ann on "Gilligan's Island," is serving six months' unsupervised probation after allegedly being caught with marijuana in her car.

She was sentenced Feb. 29 to five days in jail, fined $410.50 and placed on probation after pleading guilty to one count of reckless driving.

Under a plea agreement, three misdemeanor counts — driving under the influence, possession of drug paraphernalia and possession of a controlled substance — were dropped.

On Oct. 18, Teton County sheriff's Deputy Joseph Gutierrez arrested Wells as she was driving home from a surprise birthday party that was held for her. According to the sheriff's office report, Gutierrez pulled Wells over after noticing her swerve and repeatedly speed up and slow down. When Gutierrez asked about a marijuana smell, Wells said she'd just given a ride to three hitchhikers and had dropped them off when they began smoking something. Gutierrez found half-smoked joints and two small cases used to store marijuana.

1) DUI
2) paraphernalia possession
3) AND possession of marijuana

that's a pretty fair sentence, and pretty typical.

fwiw, most first time offenders for misdemeanor mj possession get a fine only. this case was ALSO a dui.

iow, this is not a good example against the drug war, since it's entirely reasonable considering the DUI offense.

the article also doesn't state if it's her first DUI, what her past record is, etc. in my jurisdiction very rarely does anybody serve ANY time for DUI without priors.

look at age of consent. i used to live in a state where it was 14. in others, 16. in some 18.

is that arbitrary? sure. but the law has to draw arbitrary laws at times.

regardless, the .08 level IS based upon a hell of a lot of peer reviewed studies. feel free to review the data from NHTSA. the issue isn't whether you FEEL impaired. it's wheter you are.

impaired is NOT 'drunk'. it's a lesser standard.

for example, a very fatigued person is EASILY the functional equivalent of your average .10.

regardless, the law is somewhat arbitrary, but it's a bright line distinction, AND it doesn't impose upon any right, fundamental or otherwise. there is no RIGHT to be a .08 and drive.

so, it's perfectly fair imo.

She gave them a ride, dropped them off, and THEN they began smoking something? If they started smoking AFTER she had dropped them off, why the smell in the car?

She was giving them a ride, they fired up, she stopped and put them out. Is that simple enough? (Not that I believe that story, but it's not too hard to understand)...
