Remember how the Janet Jackson “Boob Gate” story had the angry Conservative watch dog groups up in arms which as usual filtered down into the MSM? A court threw out the ridiculous fine against CBS.

When Janet Jackson’s now infamous “wardrobe malfunction” occurred at the 2004 Super Bowl halftime show in Houston, any viewer who blinked missed the nine-sixteenths of a second exposure of her right breast as fellow performer Justin Timberlake tugged at her costume..

Not so fleeting was the near-hysterical reaction of the Federal Communications Commission, which launched a four-year morality crusade against indecency on the public airwaves and fined CBS $550,000. FCC officials failed to establish that CBS had advance knowledge of the stunt and wrongly concluded that Jackson and Timberlake were employees of the network.

In going after CBS, the FCC abandoned a long-held policy of ignoring brief, unscripted incidents of nudity or vulgarity beyond the control of broadcasters. The commission, then headed by chairman Michael Powell, also went after Fox Broadcasting for incidents in which Cher and Nicole Ritchie uttered expletives during awards shows. Moved by the tempests on a TV screen, Congress jumped into the act by increasing indecency penalties tenfold.

5. The FCC, not the FTC

And the FCC has been out of this for a long time - - what happened this past week is that the Third Circuit U.S. Court of Appeals (covering PA, DE, and NJ; a fairly sensible appeals court) threw out the fine on appeal. It was a good development.

One wonders what those conservative watch-kittens who concern themselves with such 'indiscretions' as this do for fun.... watch the grass grow in order to early catch the wayward dandelion which would have the gall to grow defiantly on their precisely manicured lawns?

These self appointed morality police must be apoplectic over such shows as are on Comedy Central. If it were up to me I would strap them to a chair ala-'A Clockwork Orange' style and force 'em to watch the entire run of South Park. If they didn't begin giggling by season three, I'd say they were too far gone to be allowed loose in society.

Glad to see that our ever vigilant Congress taking time off from their busy schedules to lend their hand in this issue too. One can only imagine the fierce debating this important matter must have caused before being passed on to the House Judiciary.

This all causes me to wonder if the silky smooth "BOOB OF JUSTICE" is still covered. Does anyone know if that songbird Ashcroft's drapery has been removed yet or is America's Justice still hogtied?
