Considering that the filthy Bastard is still in Office, why aren't we blocking recess appointments?

The last several times the the Senate has been in recess Harry has had to send someone to town every day to open a pro-forma Session of body and then shut it down immediately. The purpose was not to be out of session for more than (can't remember, is it 3 days?) the time period which allows the President to make Recess Appointments. I know Bush still has a brood of Federal Judges he'd like to appoint.
