Democrat Christine Jennings has new reason to hope she may still be seated in the 110th Congress after a Florida court ruled in her favor yesterday, denying a motion that would have ended her appeal for a new election in Katherine Harris's old district in Sarasota. But the race -- and Jennings's legal case -- is far from decided.

Her appeal is based on widespread complaints that electronic voting machines in Sarasota County failed to record thousands of votes in the race. The official count shows Jennings losing to her Republican opponent, Vern Buchanan, who has been sworn in provisionally, by 369 votes. According to the official tally, 15 percent of those who turned out on Election Day chose to skip over the Congressional race. But hundreds of voters reported that though they tried repeatedly, they could not get the touch screen voting machines to register a vote in that one race. Earlier, a Florida circuit judge had denied Jennings's access to the voting machines, citing privacy concerns for the manufacturer, Election Systems & Software. She appealed that ruling, and the district appeals court yesterday dismissed a motion that her appeal be denied, which means that the case can now go forward: "It's a good sign they're open to considering it," said Jennings campaign spokesman David Kochman. "It would have been a tough hit if we had lost it."

A new report from electronic voting experts casts doubt on Florida's official position, which is that it was poor ballot design that led to the undervote. The authors of the report, David Dill of Stanford University and Walter Mebane of Cornell University, wrote that "a very strong statistical link between a specific error message in the machine's event log and a high undervote rate on that machine may be an indication of a mechanical cause of high undervotes."

And former Democratic Indiana Congressman Lee Hamilton, co-chair of the Iraq Study Group, also weighed in yesterday, writing in an op-ed published in the Missouri Valley Times that, "As the 110th Congress convened January 4, its members had only to look around them to be reminded of an issue they should be addressing this session. Indeed, they could look this reminder right in the face: His name is Vern Buchanan."

2. HOORAY! It is so totally OUTRAGEOUS that ES&S refuses to disclose its
"TRADE SECRET," PROPRIETARY programming code, in an election with such red flags to fraud!

Is this America, or what? "TRADE SECRET" code in our elections?

ES&S: A spinoff of Diebold (similar computer architecture-Windows), initially funded by rightwing billionaire Howard Ahmanson, who also gave one million dollars to the extremist 'christian' Chalcedon Foundation (which touts the death penalty for homosexuals, among other things). Diebold and ES&S have an incestuous relationship; until recently, they were run by two brothers, Bob and Tod Urosevich. (One of them got outa Dodge last year--can't recall which one.)

These are the people who "counted" 80% of the nation's votes in 2004, under a veil of corporate secrecy.

'06 showed that we can outvote the machines when we are quite determined to do it--but why should we suffering what I and others have estimated to be a 5% to 10% "thumb on the scales" for Bushites, warmongers and corporatists?

And one of the guys who did this to us--Christopher Dodd--is running for president. And the other one--Terry McAuliffe--is running Hillary's campaign.

These are the Democratic rotters who colluded with the biggest crooks in the Anthrax Congress--Tom Delay and Bob Ney--to pass the "Help America Vote for Bush Act" of 2002 ($3.9 billion electronic voting boondoggle that corrupted our election system and turned it over to Bushite corporations).

It's like the sewers of Rome have been unplugged.

5. whatever happens I respect
Christine Jennings for fighting the good fight. If she loses and runs again in 2008, I hope people remember what she is doing now and contribute to her campaign.

I wonder what they mean by mechanical... It's fixed components for the most part. The only thing mechanical would be the hard drive. (if it has one) Are they talking about read write issues? ... or something with the ballot card process I wonder?. It's an interesting choice of words for an expert to make.

What an interesting statement from ES&S (I'm assuming).

If the hard drive is *not* the only mechanical component, I'd like to know what the others are. (Hmmmm.... A lock and key, perhaps.... ;) )

And I'd like to know how multiple hard drives can fail mechanically in *exactly* the same way so as to cause undervotes and not plain old crashes.

I think you've put your finger on a rat here.....

What other decision could they have offered...the rights of a privately held corporateion outweigh the rights of the citizens of the 13th Congressional District. I think not.

Way to go Florida court!!!
