Ex-cop who saw "demon" sues to get gun, badge back

"Dominic Maglione, a desk officer at Brooklyn's 90th Precinct, says in a lawsuit filed in Manhattan's state Supreme Court that he is a Christian who worships at two Queens churches and prays and fasts regularly."

The AP adds, "At the hospital, Maglione told a medical professional that he had seen a demon at police headquarters, according to a police board medical report dated Dec. 19, 2008, that was included with Maglione's court papers. The report also says the lieutenant lost 40 pounds in six months by fasting, and urinated on himself because he refused to stop praying to go to the bathroom."
"The Medical Board believes that the lieutenant cannot be allowed to be in possession of any weapons since he feels subject to God's will to do what God wants him to do even if he destroys himself," the medical report said.

The AP story continues, "The 22-year police veteran says that because of his allegedly 'excessive' religious beliefs, police officials have 'wrongfully and illegally' confiscated his gun and badge and compromised his ability to do his job. Maglione's lawsuit, filed Feb. 19, says that curtailing his duties because of his religious practices violates his First Amendment rights. He asked the court to order his return to full police work.">>>> -snip-

7. It sounds like schizophrenia to me
That often manifests itself via religious expression if the person has such a predisposition. In other words, his religiosity seems like a symptom rather than a cause.

10. I wonder...
If the guy is "seeing" mythical beasts or things that aren't there, it makes sense that he's suffering from schizophrenia.

But what if he's seeing perfectly normal people who truly exist, and applying the "demon" label as a result of his religion...kind of like Fred Phelps?

14. I agree - a lot of people with schitzophrenia have very similar
behaviors. A lot of them are in very "close contact with god" as well, don't eat or keep themselves clean and see things not visible to others.
I once had a co-worker who was very "religious" and saw "demons" on the main streets of his town. He said several times to me,"You think I'm nuts, don't you."

Well, yeah.

Sees Demons every were,acts like god, bipolar and obsessive compulsive,... yep sounds like a cop to me
I wonder when they get hired do they have to check a box that says "Yep I'm nuts". Ever problem cop out there seems to have a whole lot of problems you would think they would set up some sort of annual screening process for people that get to wave the guns around and apparently look after our best interests.

16. they have to
in every agency i am aware of , and work(ed) for take a batter of psych tests to get in.

MMPI, etc.

however, cop unions etc. have fought any mandatory physical or psych assessments once probation is over (1 year) unless sufficient cause can be shown. iow, it generally can't be required unless there are specific reasons to suspect it.

certainly, in this case they did the right thing by taking away the guy's gun.

but in brief, unlike almost any other profession, cops ARE subject to a battery of psych tests and interviews with MHP's before being hired.

11. Well Thats Simple
In his world all he needs to say is his badge is a holy shield and his bullets are blessed by god. He and he alone can only battle the demons and the his job that was taken away from him is an extension of his religion come on don't you have faith in this guy look he said he can see and do these things. I mean your not asking for Proof are you hell id say lets use this new tool delivered from the almighty to smite the enemy's of the under depths once and for all. Maybe he can even shoot demons into pigs or raise his fellow cops from the dead if they are taken out see now all you need to do is use faith and there ya have it. Constantine has nothing on this guy I smell a buddy cop movie in the works, maybe we can get Mel to direct.

Then again were all Rational fact based people aren't we.
