Reid Spokesman: Coleman Doesn't Get Another Election

Harry Reid's office is now indicating its displeasure and opposition to Norm Coleman's new attempt to potentially throw out the whole election result in Minnesota.

Said Reid spokesman Jim Manley, in an e-mail to TPM: "Just because Mr. Coleman is not happy with the results of the election/recount doesn't mean he gets to schedule another one."

19. Kind of reminds me of Lieberman
Perhaps Coleman can start a third party called "Minnesota for Coleman". It worked like a charm for Lieberman. I've always been astounded that so few noticed that Lieberman's third party was called Connecticut for Lieberman not Lieberman for Connecticut. That was just so self centered, it made my brain hurt.

"The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof, for six years."

Franken has not yet been elected. I don't really think it was the framers' intent that the Senate could simply decide to seat whoever it damn well pleased without regard to the decisions of the States, or of the State's electorate after the seventeenth amendment. Rejecting a Senator as unqualified is one thing; declaring that an unelected person can be a Senator is something else.

5. What exactly does Reid have to do with scheduling a State election?
Coleman has nothing to do with one either but it is up to the State of Minnesota whether they schedule another election, not Reid. I suppose the US Senate could just go ahead and seat Franken but not sure how that would work out legally.

14. Franken has not been certified the winner of the election.
Reid doesn't have the power to swear Franken in as Senator any more than he has the power to swear me in as Senator. It is not Harry Reid's call, nor should it be.

23. No. Election law here in Minnesota makes no provision for a do-over.
Coleman's team is grasping at straws when they suggest otherwise:

And on Monday, Coleman lawyer Jim Langdon wrote the three-judge panel to suggest the problems are so serious they may not be able to declare a winner.

"Some courts have held that when the number of illegal votes exceeds the margin between the candidates -- and it cannot be determined for which candidate those illegal votes were cast -- the most appropriate remedy is to set aside the election," Langdon wrote in a letter to the court.

"Some courts"? Some courts where? Not in Minnesota. Furthermore, the Coleman team has failed to demonstrate that any of the votes counted were "illegal". Baseless allegations and innuendo are all they've had to offer in five weeks of testimony.
