NEW YORK (Reuters) - Lawyers for Bernard Madoff argued that a U.S. court erred in jailing him pending sentencing and will ask an appeals court to reinstate his bail and house arrest, according to court papers filed on Friday.

Madoff, 70, was jailed on Thursday after pleading guilty to running the biggest investment fraud in Wall Street history.

A three-judge panel in the U.S. Court of Appeals for the Second Circuit in New York will hear oral arguments on March 19 on two motions by Madoff's lawyers, a court official said.

One motion aims to suspend an order made at Thursday's plea proceeding by U.S. District Judge Denny Chin to revoke Madoff's $10 million bail. Madoff was arrested last December 11.

The panel will also hear a motion from the lawyers to reinstate bail conditions so Madoff can return to house arrest in his $7 million Manhattan penthouse.

1. I don't think he'll get out,
unless a physician can produce evidence that his health is being damaged by being held in that particular slammer, where the medical care might not be as good as it is in a totally residential prison.

There was talk for a while that he had a terminal illness, and that's why he busted himself to his sons.

I smell Ken Lay all over again....................

4. He won't spend it. He's been trying to hide and protect what's left.
He's already admitted to several felonies, so he's going to spend time in prison anyway. May as well do some time now so he gets "time served."

Given that the average white collar criminal spends 18 months behind bars, there's a good chance Bernie may get out in time to enjoy his remaining golden years on the $$$ he's already diverted to family and friends.

5. Can you imagine....

..being 70 years old and living your life with every luxery imaginable, and then having to spend the night in a cold jail...with a hard bed....maybe one thin blanket....and none of your possessions around you?

It would suck pretty bad. Let that be a lesson to you, kids.

12. And that's the problem, isn't it? Even when one of the parasites does get caught,
we feel that somehow they are not deserving of the punishment we mete out to "average schmucks".

This monster has caused far more pain, suffering, and death than some asshole that holds up a 7-11.
