IL: No jail time for sadist pastor who hit 12-year-old with crown molding as 'discipline'
http://www.pamshouseblend.com

Daryl P. Bujak was found guilty of two counts of battery but not guilty on the charge of failure to report a suspected sexual assault.
--------------------------------------------------------------------------------

Again, "suffer the little children" takes on a new meaning for an amoral spiritual leader. This time, it's Elgin, IL, and the pastor is Rev. Daryl Bujak of the First Missionary Baptist Church. He's on trial, accused of clearly un-Christian behavior -- battery on a young girl who was 12.

Rev. Daryl Bujak didn't believe the girl when she said she had been sexually abused, and he wanted to cure her rebellious at-home behavior. So week after week, when her mother brought her in for counseling, he allegedly punished her with a bruising spanking.
...Bujak is accused of battery for allegedly beating the girl, who was 12 at the time, with a piece of crown molding during their weekly counseling sessions at First Missionary Baptist Church in Elgin.

...The girl, now 16, took the witness stand Tuesday and described nearly ritualistic spankings during her meetings with the pastor. She said the number of blows depended on her mother's account of how she had behaved at home that week.

"Fifteen was a good week," she said.

The spankings raised painful welts, the girl said, and her backside became so sore she had to sit on her hands during the church service.

Bujak's attorney, Ross Bartolotta, admits his client hit the child in this manner; the defense is that the "discipline" was legal because it was approved by the parents. I can't imagine the level of trust that has been destroyed in this girl by the evil perpetrated by her own family; they might as well have dealt the blows themselves.

4. She can't sue her parents, alas -
a concept known as 'parent-child tort immunity' - but I hope she nails that fucker with a civil suit.

You just KNOW that fucker had an erection while he was beating her. Don't you?

Oh, how I'd like to be alone in a locked room with him, just for a little while........................

6. The stepfather likely has no such legal protection, yes?
Obviously he didn't adopt, or he would have been named as the "adoptive" father.

16. That's a good question -
I don't know that answer, but my first guess would be that the stepfather, even without the legal caption of being her adoptive father, would enjoy the same immunity as a biological father, the operative concept in the time-honored tradition of "parent-child tort immunity" being "parent." Not father, not adoptive father, not biological father.

Parent.

So my best guess is that the stepfather would like fall under the protection of parent-child tort immunity.

8. OMG! The accused abuser relative agreed to the girls spanking also. SICK SICK SICK
The Rev. Daryl P. Bujak, 30, pastor at First Missionary Baptist Church at 385 Silver St. in Elgin, was disciplining the girl for making the allegations, Elgin Police Lt. Mike Turner said.

The girl's mother and the accused relative agreed to the discipline, which involved Bujak allegedly spanking the girl repeatedly with a three-foot by two-inch piece of wood molding on Wednesdays prior to church services from March to May 2005, Turner said.

9. More: Paster told the abuser to spank the girl also. Abuser has been charged with sexual abuse
he 13-year-old's mother told the Northwest Herald Thursday that she and the accused, Matthew Resh, brought the girl to Bujak in mid-March 2005 because the mother thought she was lying about the sexual assault allegations.

"She always lied a lot, so when she said these things about Matt her credibility was already damaged," the mother said. "She could have easily been lying about this as well."

The mother said the first time they met with Bujak he told them he was a former police officer and had worked with "tons of molested teens."

The girl suffered bruises and welts to the back of her legs and buttocks. Bujak, who turned himself in on Wednesday, was charged with one misdemeanor count of battery.

Bujak also told Matt Resh that he should spank the girl, the girl's mother said. Matt Resh, 33, of 26445 W. Route 134, Apt. 6, Ingleside, was charged Monday with five counts of predatory criminal sexual assault of a child. Resh is a former member of the Richmond Plan Commission.

10. More: Paster would spank the girl 30-40 times in one sitting, abuser would spank 100 times.
Edited on Thu Mar-19-09 01:54 AM by Liberal_in_LA
"It would be nothing for to spank her 30 or 40 times at one sitting," the mother said. "Matt did the same thing. He would spank her like 100 times at one sitting."

Bujak would spank the girl once a week and the relative would spank her more often, the mother said.

The girl's mother admitted that, in hindsight, the entire situation looked odd.

"I should have been more assertive," she said.

The mother said she notified police in October of the alleged sexual abuse. "Now I'm like, what did I put my daughter through."

Mom belongs in jail also.

13. I agree that the mother deserves to be charged, but
I have to wonder if she herself was not also a victim of abuse. It takes some special kind of evil to allow another to harm/hit/abuse ones own child. I just wonder if she wasn't put into a position that prevented her from protecting her daughter. It would makes a lot more sense to me.
