MN COURT: FRANKEN WON; BUT AP REPORTS: 'FRANKEN LEADING VOTE-GETTER'?!
World's most influential news outlet downplays the WINNER of the U.S. Senate race in MN, following final ruling from bi-partisan state election contest court...

That's right, according to AP tonight, following the just released final ruling from the 3-judge election contest court in Minnesota, Senator-elect Al Franken (D-MN) is not the "winner" of the election. Rather, he's merely the "leading vote-getter".

Are they kidding?! "Leading vote-getter"?! Apparently not....

1. I was under the impression that the "leading vote-getter" phraseology....
was a direct quote from the opinion.

Is that not the case?

10. Court decision was clear...

Here's what they found:

Franken received the highest number of lawfully cast ballots in the November 4, 2008 general election for United States Senator for the State of Minnesota and is entitled to receive the certificate of election.


Now what do we call someone who has "received the highest number of lawfully cast ballots" in an election, and who "is entitled to receive the certificate of election"?

Anybody? Beuller? Only in 2009 AP Bizarro World is that not a WIN. Hell, AP declares candidates have "Won" on election night before there has even been any canvass whatsoever, or for that matter, before every vote has been counted (like has been painstakingly done here over the past 6 months!) NYTimes did the same. See my update on that at the linked original report.

In rejecting Coleman’s arguments, the panel said the Republican essentially asked it to ignore Minnesota election requirements and adopt a more lenient standard allowing illegal absentee ballots to be counted.

The panel also rejected Coleman’s comparison of Senate election problems to those in the 2000 presidential race in Florida.

7. Coleman loses; case set for state Supreme Court (The Hill)
... Franken is still unlikely to receive the certificate of election he will probably need to be sworn into the Senate. Gov. Tim Pawlenty (R), who is responsible for signing such a certificate, has indicated that Minnesota law won’t allow him to sign it until Coleman has exhausted his case in state court.

14. He won't sign when Franken wins the state supreme court appeal either.
I'm sure Pawlenty thinks Minnesota law won't allow him to sign the certificate until Coleman is ahead.

What's scarier: As newspapers and other media gather less and less of their own news, they rely more and more on AP UPI and Reuters. The stories of those news services get reprinted EVERYWHERE.
