Supreme Court upholds FCC fines for 'fleeting expletives'

The Supreme Court ruled Tuesday in a 5-4 decision that the Federal Communications Commission (FCC) can fine "fleeting expletives" — single curse words that escape censors during broadcasts.

The court upheld FCC fines levied against Fox for fleeting expletives used by celebrity Nicole Richie during a 2003 broadcast of the Billboard Music Awards, overruling an appeals court on the issue.

The court's five reliable conservative justices voted to uphold the policy, while the court's four liberal justices found themselves in the minority. Justice Antonin Scalia authored the opinion.

"The {FCC} could reasonably conclude that the pervasiveness of foul language,and the coarsening of public entertainment in other media such as cable, justify more stringent regulation of broadcast programs so as to give conscientious parents a relatively safe haven for their children," Scalia wrote in the opinion.

The policy could still face a challenge, however: Scalia was careful to note that the court's decision did not touch upon the First Amendment implications for the policy, but rather, the appeals court's finding that the FCC policy was "arbitrary and capricious."

2. Personally I think this is stupid
because people use those words all of the time, but on the other hand any time Fox gets a backhand slap is ok with me.

6. The FCC needs to be reined in.
It's gotten way, WAY out of hand. I am sick to death of the hypocritical mindset that allows some asstastic parents to whine about their kids hearing a "bad word" on TV, and then turning around and screaming at Junior go "Go clean your fucking pig-sty of a room!"

This happens more than anyone would like to admit.

7. Protect the children!!! OMG! What about the children!!!...
Trust me, little Janie and Johnnie are hearing, and speaking, just about everything during recess everyday. We teach our kids that some things are for adults - movies, drinks, some words. And when they're older, they'll be able to make their own decisions about those "adult things".

That said, my 8-year old, who is enrolled in a French immersion school, still enjoys telling everyone he knows that the French word for "seal" is "phoque". :rofl:

NO CENSORSHIP. EVER. PERIOD.

For fuck sakes, why do some many retarded bastard asshole people have to be so fucking obsessed with a few goddamn curse words? How the fuck does somebody on tv saying "fuck" affect your shitty life? We have to end ALL government censorship. If you think keeping expletives off tv will keep the kiddies all pure and wholesome, then you are completely wrong. The Internet has rendered censorship of TV completely moot, because you can find anything in about 3 minutes on the Internet. Fuck the Supreme Court.
