Leahy invites Bybee to testify before Senate Judiciary Committee.


Today, Senate Judiciary Committee Chairman Patrick Leahy (D-VT) sent a letter to Judge Jay Bybee inviting him to testify about his “views” about torture and his “role” in drafting the torture memos. “There is significant concern about the legal advice provided by OLC while you were in charge, how that advice came to be generated, the considerations that went into it, and the role played by the White House,” Leahy wrote. “I look forward to your cooperation and your testimony.” Read Leahy’s letter (pdf) here.

6. Leahy must follow the procedural avenues first
There hasn't been any committee appointed for this, and there really shouldn't be. There should be an independent investigation because Congress's actions are in question too.

8. Subpoena is 2nd level invite - Mr. Bybee, we asked out of courtesy, but we REALLY MUST INSIST

Protocol would dictate that it would be unseemly to subpoena a sitting Federal judge. Sucks, yeah, but it's not a good idea.

A simple invitation - which, of course, Bybee wlll ignore - does enough to stir it up and to have, on the record, the undeniable fact that Bybee was very courteously invited and declined. Or ignored it. I'd like if he never even responds.

How very rude that would be.

That's the kind of stuff that accumulates. In The Death Of A Thousand Cuts, you've got to start somewhere. This is good ...............

The Senate Judiciary Panel is my favorite because some of them are former USAs and they don't take BS from anyone.
