Correct me if I am wrong*. Obama hasn't decided to withhold publication of the photos.
He has decided to challenge the court ordered release of the photos.

The court will still decide if the government's challenge has merit, right?

Bush lost in court. Maybe Obama will lose in court also.


*as if I needed to say THAT on DU! ;)

13. Right. Much better for the court to decide
than for the right to be able to point the partisan finger. This was the correct move because the pictures will be released. The court hasn't defended withholding this sort of thing yet.

He's just reserving the right to challenge the court order. The deadline for "the Government" to decide is June 9. Am I reading it right?

20. There is no proof of this thought,
but what if the President intends to put these issues on the back-burner until after the 2010, or even the 2012, elections when he has nothing to lose? As a constitutional scholar, and a virtuous person imo, I just don't see him letting this go.

I know, perhaps this is wishful thinking. But it would take this away as an issue in the coming elections, and there would be nothing republicans could do in his second term. They can whine all they want, but he is going off into the sunset after his (hopefully) second term anyway.

Just a thought.
