2. Then the ban is a violation of the 14th amendment
If you could be gay and get married before November 4, 2008, there is not equal protection for gay couples after November 4, 2008.

3. Lots of things have been banned in California and grandfathered if done before a certain date
It's the way things are done here when the people or the government decide to outlaw something that people have already done.
