And our old friend the ticking time bomb scenario just doesn't hold water, because it's so full of holes. If the suspect has been under surveillance, how is it that the authorities wouldn't know where he's been recently or who any of his associates are? If the suspect hasn't been under surveillance, how would the authorities know the time bomb is planted and ticking? The suspect just comes walking in off the street to announce, "Hey guys, guess what? I just planted a time bomb, and it's set to go off real soon!" Not likely.

But suppose it really has happened. What's going to get the suspect to give out correct information? "Okay, stop! It's set to go off at 11 o'clock at the federal courthouse." But it's really set to go off at 10:30 at city hall. Is someone going to keep torturing the guy just in case he's lying? And which story should be believed, assuming the suspect gives different accounts? And if the suspect is truly a committed believer in using violence and terror to further whatever his cause is, would he decline to lie just because some "good guys" are using his nuts as maracas?

No. Torture isn't justified.
