LOL !!! - Just Watched A Movie Ad On MSNBC, 'The Kids Are Alright'
Obligatory promo reviews that suggest a great family film... or maybe, it's a great film about family.

1. I wonder how they got away with using the same title as
The Who movie from the 70s? Aren't titles copywrited? Sorry, don't mean to wander off course, just curious if anybody knows.

9. I wonder if that could be true. Someone down thread said that
movie titles can't be copywrited, but The Kids Are Alright is a song title. He may have had to sell them the right to use his song title ( cause Roger needs the money, of course).

If The Who had created a trademark of "The Kids Are Alright," and defended that trademark over the years, there could be a case.

The creative content of the movie IS copyrightable, and it was certainly copyrighted. However, the only way there would be an infringement would be if this new movie ripped off all or part of The Who's movie. It didn't. There is nothing similar about them, therefore there is no copyright infringement. Check out song titles, for instance. Lots of songs by different artists bear the same name, but they aren't remotely the same song.

I think you could probably find that the phrase "The kids are alright" was used long before The Who wrote a song or a movie. Again, you can't copyright words. You can trademark them IF they identify a particular, unique product, but even then, someone else can sell a product with the same name as long as it is shown that there would be no confusion among consumers. For instance, a camera company can sell a camera called the "Focus," while Ford sells a car called the "Focus," because no rational person would confuse a $100 camera for a $20,000 car. But either way, the mere word "focus" cannot be copyrighted.

13. I still remember living Ellen going from TV PG to TV PG13 after she came out
even episodes that had previously had the lower rating were rerated post the Puppy episode.
