Lt. Col. Terrence Lakin will appear before a military judge Aug. 6 to enter his plea in a court-martial proceeding that are currently ongoing against the former Greeley resident.

Lakin is being court-martialed by the Army for refusing to obey orders to deploy to Afghanistan because Lakin believes the President has refused to prove his eligibility under the Constitution to hold office. Lakin wants Obama to show his birth certificate.

A trial is presumed to be scheduled before October. It will be held in Washington at Fort McNair.

“I am not guilty of these charges,” Lakin said in a news release. “And (I) will plead ‘not guilty' to them ... If President Obama is a natural born citizen then the American people deserve to see proof, and if he is not, then I believe the orders in this case were illegal.”

If convicted, Lakin faces up to four years in a federal penitentiary

as a soldier i should just post the item and leave it at that. what are your thoughts on this conduct?

update!*****the follow up is fantastic--the good news just keeps coming this week:--

Lakin’s father Frank told the Greeley Tribune Friday that his son’s video wasn’t representative of the family. “This does not reflect the opinions or the attitude of the family by any means,” he said. “We’re Obama supporters.”

I'm not familiar with military justice but is a soldier allowed to decide if an order is legal?

10. yes and no
an order is presumed to be legal. So a Soldier should ordinarily follow it, to not do so, he does at his peril.

But he also cannot follow an illegal order, so he has a duty not to follow illegal orders.

But the universe of illegal orders is very small, kill that infant for example, or rape that woman, two very obvious illegal orders.

Deploy even though you think I might not be natural born would obviously not fall within that universe.

I know the judge involved. A very, very nice woman. She will make sure he is feeling ok, make sure everything goes right, and then, if they decide to go judge alone, she will absolutely hammer him. Her nickname has been the velvet hammer.

If he goes panel (jury), he will also get hammered because a bunch of senior officers will be pulled away from their duties to deal with him and they will not be happy about it.

I think he gets at least six months, maybe more along with a dismissal.

13. DId you catch where the hearing officer is allowing Alan Keyes to be called?
I mean, I feel for the judge, and the potential jury, but I am certain that Ambassador Keyes will provide 'dinner and a show.'

Sure.

But here, Lakin is tasked with explaining why he can't follow the order of a Congressional Medal of Honor winner to merely deploy.

The order he is charged with defying did not issue from President Obama.

It issued from Col. Gordon Roberts, who won the CMH at 19, in Vietnam. He refused an order to report to Fort Campbell, KY and thence to follow deployment to Afghanistan.....

And that's what he's gonna have to answer for, and he's not gonna be able to make some crazy ass claim that the Army is obligated to prove to him that every official from Roberts on up to Obama is the legal holder of office they currently occupy.

Now, the hearing officer is allowing Lakin to call Ambassador Alan Keyes. That should be fun.

and I wouldn't even give his ass the time of the day much less than seeking shrink help.

He needs to serve more than 4 years - he needs to serve life for treason and dumped in the worst possible fed prison

9. He doesn't have a leg to stand on..Obama did not issue
the orders to deploy...His outfit did. Nothing had Obama's signature on it. I think the guy was chicken and didn't want to go and used this as an excuse.
