Senate sends 5 judicial nominations back to White House including Goodwin Liu

Goodwin Liu, Associate Dean and Professor of Law at the University of California, Berkeley School of Law.
Former nominee for the United States Court of Appeals for the Ninth Circuit
39 Years Old

All nominations received by the Senate during the 111th Congress so far will remain in status quo notwithstanding the August 5, 2010 adjournment of the Senate by unanimous consent, with the following exceptions:

• Louis Butler to be United States District Judge for the Western District of Wisconsin
• Edward Chen to be United States District Judge for the Northern District of California
• Goodwin Liu to be United States Circuit Judge for the Ninth Circuit
• Robert Chatigny to be United States Circuit Judge for the Second Circuit
• John McConnell, Jr. to be United States District Judge for the District of Rhode Island

1. Press report: Senate sends 13 nominations back to White House
The Senate Thursday night confirmed more than 50 executive nominations by unanimous consent, but it "returned" 13 nominations, including some of the most high-profile officials, meaning they must be renominated.

Senate rules require dropping nominations during an adjournment if there is no agreement to keep them on the calendar. A unanimous consent agreement that kept other nominations pending allowed the 13 to be returned.

The 13 include Centers for Medicare and Medicaid Services Administrator Donald Berwick and National Labor Relations Board member Craig Becker. President Obama gave both recess appointments, but Democrats are seeking full terms despite some GOP opposition...

Among the five judges' names returned are two strongly opposed by Republicans: Goodwin Liu, a law professor nominated to an appellate court judgeship, and John McConnell, a district court nominee.

4. My e-mail to the President:
Last night the Senate sent 13 nominations back to the White House. Among those were 5 very qualified judicial nominations. The Senate has blocked and stalled multiple nominations including Jane Stranch who has been waiting for an up or down vote for about 9 months now.

Please consider recess appointments for all five. If not please re-nominate all five of them ASAP.

7. A recess appointment lasts only until the end of session
I believe that would be five months from now. After that the Senate would have to confirm them for a life term. Is it worth it?

9. After 2010
Yeah, if Obama waits until the first recess after the first of the year then at least they'd have a job for closer to two years. I think it would be hard on the nominees to give up their current jobs to take the recess appointment if they know they could be booted out in five months.

But if he appoints them now and then their appointment ends at the beginning of the new congressional session could Obama re-appoint them a second time in 2011 during the first recess?

12. How Long Does a Recess Appointment Last?
A recess appointment expires at the end of the Senate’s next session or when an individual (either the recess appointee or someone else) is nominated, confirmed, and permanently appointed to the position, whichever occurs first. In practice, this means that a recess appointment could last for almost two years. If the President makes a recess appointment between sessions (of the same or successive Congresses), that appointment will expire at the end of the following session. If he makes the appointment during a recess in the middle of a session, that appointment also will expire at the end of the following session. In this case, the duration of the appointment will include the rest of the session in progress plus the full length of the session that follows.

A comparison of two recess appointments during the 108th Congress illustrates the difference in recess appointment duration that results from the timing of appointments. During the recess between the first and second sessions, President George W. Bush appointed Charles W. Pickering to an appeals court judgeship. Several weeks later, during the first recess of the second session, President Bush appointed William H. Pryor to a judgeship on another appeals court. Pickering’s appointment expired after less than 11 months, at the end of the second session. Pryor’s recess appointment would have expired after approximately 22 months, at the end of the first session of the 109th Congress.18 Although the Pickering and Pryor recess appointments were only several weeks apart, Pryor could have served nearly twice as long because his appointment was made during an intrasession recess.
